Which court handles jurisdiction

One Probate Court serves all of Macon County from the Macon County Courthouse in Oglethorpe. The court serves Oglethorpe, Montezuma and the unincorporated communities across the rest of the county.

Georgia has a Probate Court in every county, and Macon County probate filings go to the Macon County Probate Court, not to a district office. Administration may be granted only for someone who lived in Macon County at death, or for a nonresident of Georgia who owned property in Macon County or had a cause of action here (O.C.G.A. § 15-9-31). If the filing is a petition for an order that no administration is necessary, venue follows O.C.G.A. § 53-2-40.

The jurisdiction process

  1. Locate the original will and death certificate. Whoever has the will must file it with the Macon County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). The county's estate page asks for petitions to be typed or printed and legible, and for a certified death certificate if one is not already on file locally.
  2. Choose the right Georgia petition. With a will, choose common form or solemn form probate under O.C.G.A. § 53-5. Common form does not become conclusive for four years from the order admitting the will (O.C.G.A. § 53-5-19). With no will, use the letters of administration path under O.C.G.A. § 53-6-20, unless a different statewide route fits.

  6. Take the oath and address bond. Before letters issue, the petitioner must take the oath before the probate judge or a clerk, not a notary. An out-of-state petitioner can use GPCSF 53. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50).
  7. Receive letters and start administration. After the court approves the petition and the petitioner qualifies, the court issues letters testamentary or letters of administration. Those letters are the authority third parties usually need for estate settlement tasks.
  8. Publish creditor notice and manage deadlines. The personal representative must publish notice to creditors within 60 days of qualification, once a week for four weeks, in the county's official newspaper. Creditors who do not notify the personal representative within three months of the last publication lose equal participation rights under O.C.G.A. § 53-7-41.
  9. Inventory, pay claims and distribute. File the inventory with the Probate Court and mail copies to heirs or beneficiaries within six months of qualification unless the duty is waived (O.C.G.A. § 53-7-30, O.C.G.A. § 53-7-32). Pay valid claims and distribute remaining property according to the will or Georgia law.
  10. Close the estate. When administration is complete, file the required fiduciary compliance report and, when appropriate, petition for discharge using GPCSF 33.
