Walton County includes the city of Monroe, the city of Loganville, the city of Social Circle, the town of Jersey, the town of Goodhope, the town of Between, the city of Walnut Grove and the unincorporated county. Loganville and Social Circle both cross county lines, so a mailing address in either city does not by itself prove Walton County venue.
Georgia has a Probate Court in every county, and a Walton County estate is filed with the Walton County Probate Court, not with the Clerk of Superior Court and not with a district office. Administration may be granted only for a person who lived in Walton County at death, or for a nonresident of Georgia who owned property in Walton County or had a claim against someone there (O.C.G.A. § 15-9-31). A petition for an order that no administration is necessary follows the domicile or real-property venue rule in O.C.G.A. § 53-2-40.

The court's staff cannot choose the petition for you.
- File at 303 South Hammond Drive, Suite 118, Monroe, by mail to the same address, or through TrueFiling if the filing is allowed electronically. A petition for year's support under O.C.G.A. § 53-3 must be filed on paper in Walton County and, if used, must be filed within 24 months of death under O.C.G.A. § 53-3-5.
- Pay costs at filing. Walton County posts $175.00 for a decedent's-estate petition, effective January 1, 2025 under O.C.G.A. § 15-9-60, plus the $15.00 indigent defense fee, effective January 1, 2025 under O.C.G.A. § 15-21A-6, other statutory add-ons, and separate service and publication costs. Confirm the current total with the court before filing.
- Handle citation, service, acknowledgment and publication. The court issues the citation, but a self-represented filer remains responsible for service, certificates of service and publication that the court does not handle. Walton County probate publication runs in The Walton Tribune in Monroe.
- Take the oath before the probate judge or a clerk. A notary cannot administer the oath. If you live outside Georgia, ask about GPCSF 53, Commission to Administer Oath, so a court where you live can administer it.
- File any required bond on paper. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50). Walton County says a surety bond must be filed with the court on paper even when the petition is filed electronically.
- Receive letters testamentary or letters of administration after the court grants the petition and you qualify. Walton County lists certified copies of letters at $10.00 each, effective January 1, 2025 under O.C.G.A. § 15-9-60, so ask how many certified copies you need.
- Publish the notice to creditors within 60 days of qualification, once a week for four weeks in The Walton Tribune. Creditors who do not notify the personal representative within three months after the last publication lose equal participation rights for distributions made before notice of the claim (O.C.G.A. § 53-7-41).
- File and mail the inventory within six months of qualification unless the duty is waived (O.C.G.A. § 53-7-30, O.C.G.A. § 53-7-32). Then pay claims, distribute property, file required fiduciary compliance reports and petition for discharge on GPCSF 33 when the estate is ready to close.

The schedule says costs are exclusive of service of process, publication of a citation or notice, guardian ad litem fees, court-appointed attorney fees, evaluator fees and any other sums required by law. In Walton County, probate publication runs through The Walton Tribune in Monroe, and the publication charge is separate from the court's filing cost.
