Before you begin — know the assets and liabilities
Before you choose a Terrell County filing path, list the decedent's assets, debts, heirs, beneficiaries and any property titled in the decedent's sole name. The right petition depends on whether there is a will, whether all heirs agree, whether creditors are known, and whether land or a home needs to be sold or transferred.
Sunset can support estate settlement by searching more than 2,300 financial institutions for accounts and assets, then organizing what you find into the information needed for the statewide Georgia probate forms.
Which court handles jurisdiction
The Terrell County Probate Court at 499 Rountree Drive, SW, in Dawson serves the entire county. Georgia has a probate court in each county, so a Terrell County estate is filed with the Terrell County Probate Court, not with another county office and not with a district office.
Administration may be granted in Terrell County only for a person who lived in Terrell County at death, or for a nonresident of Georgia who owned property in Terrell County or had a cause of action there (O.C.G.A. § 15-9-31). If the local path is an order that no administration is necessary, the petition is filed in the decedent's county of domicile, or where Georgia real property sits if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).
A party seeking review of a Terrell County Probate Court decision files a petition for review in the superior court within 30 days of the judgment (O.C.G.A. § 5-3-7(b)). The superior court proceeding is de novo, with the jury right preserved (O.C.G.A. § 5-3-5(d)).
The jurisdiction process
- File the will, if there is one. Whoever has the original will files it with the Terrell County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). Terrell County does not post estate e-filing, so the original will and any codicil go to the court on paper.
- Choose the petition and GPCSF form. With a will, choose probate in common form or solemn form under O.C.G.A. § 53-5. Common form is not conclusive for four years from the order admitting the will (O.C.G.A. § 53-5-19). With no will, use the letters of administration path and the administrator-selection rule in O.C.G.A. § 53-6-20.
- File in Dawson or by mail. File at the Terrell County Probate Court, 499 Rountree Drive, SW, Dawson, GA 39842, or mail the packet to P.O. Box 67, Dawson, GA 39842. The office is closed for lunch from 11:45 a.m. to 12:45 p.m.
- Pay the filing cost at filing. The statutory base for a decedent's-estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60, plus statutory add-ons including the $15.00 indigent defense fee, effective January 1, 2025, under O.C.G.A. § 15-21A-6, and any service or publication costs. Call (229) 995-5515 to confirm the current total before filing.
- Handle citation, service and publication. The court issues the citation. Solemn form requires notice to heirs, with personal service at least 30 days before probate unless waived (O.C.G.A. § 53-5-22). Published citations and creditor notices should be coordinated with the Probate Court and the county legal organ, The Dawson News.
- Take the oath and address bond. The personal representative's oath must be administered by a probate judge or clerk, not by a notary (O.C.G.A. § 53-6-24). An out-of-state petitioner may use GPCSF 53. Bond is required for an intestate administrator unless all heirs consent to waive it (O.C.G.A. § 53-6-50).
- Receive authority to act. Once the court approves the petition and the petitioner qualifies, the court issues letters testamentary or letters of administration. Those letters are the authority document banks, title companies and buyers usually ask to see.
- Publish the creditor notice. A personal representative must publish notice to creditors within 60 days of qualification, once a week for four weeks, in the official newspaper of the county where the representative qualified. Creditors who miss the three months after the last publication lose equal participation rights as provided by O.C.G.A. § 53-7-41.
- Administer the estate. Collect assets, safeguard property, pay valid claims and taxes if any apply, and file and mail the inventory within six months of qualification unless the duty is waived (O.C.G.A. §§ 53-7-30 and 53-7-32).
- Close the estate. After claims are handled and property is distributed, file the required fiduciary compliance report and, when ready, petition for discharge using GPCSF 33.
Forms and documents
Probate forms in Terrell County
Georgia uses one statewide set of numbered probate forms, the GPCSF series, adopted by the Council of Probate Court Judges of Georgia and approved by the Supreme Court of Georgia. A document prepared on a standard form is acceptable in any Georgia probate court, and a court may decline to process a substitute that does not conform to the standard form (Uniform Probate Court Rule 5.9).
The Terrell County Probate Court does not post county-specific estate petitions. Use the statewide forms for decedent's-estate filings, including GPCSF 3 for letters of administration, GPCSF 4 for probate of a will in common form under O.C.G.A. § 53-5, GPCSF 5 for probate of a will in solemn form under O.C.G.A. § 53-5, GPCSF 9 for an order that no administration is necessary under O.C.G.A. § 53-2-40, GPCSF 10 for year's support under O.C.G.A. § 53-3, GPCSF 32 for waiver of bond or grant of powers, GPCSF 33 for discharge, and GPCSF 53 when an out-of-state petitioner needs a court commission for the oath.
The Terrell County office says wills and estates packets are available. Treat those packets as local filing help, not as a replacement for the statewide GPCSF forms.

Scenarios
| Situation | Local path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | Jointly held property or a beneficiary-designated account may pass outside probate. If the home or accounts were in the decedent's sole name, file with the Terrell County Probate Court. Year's support under O.C.G.A. § 53-3 can set aside property, including a family home, and must be filed within 24 months of death (O.C.G.A. § 53-3-5). | Sunset helps identify which assets pass outside probate, which assets need court authority, and which documents belong in the Terrell County estate settlement packet. |
| Out-of-state adult child with a small estate | Terrell County does not post estate e-filing, so plan for paper filing by mail or at the Dawson counter. The oath cannot be notarized, so ask about GPCSF 53 if you cannot appear in Georgia. If the only asset is a bank or credit union deposit, Georgia law may let the institution release a deposit within the $15,000 limit, effective under the 2019 amendment to O.C.G.A. § 7-1-239, without a probate filing. | Sunset organizes account information, flags whether a court filing is needed, and helps prepare a packet that can be mailed or reviewed with a Terrell County probate attorney. |
| Parent settling predeceased child's estate, home must be sold | Selling a house usually requires authority from the Terrell County Probate Court. The personal representative may need expanded powers under O.C.G.A. § 53-7-1(b) using GPCSF 32, or a petition for leave to sell using GPCSF 13. If there is no will, all heirs agree, and debts are resolved, an order that no administration is necessary under O.C.G.A. § 53-2-40 can vest title in the heirs and then be recorded in the deed records through the Terrell County Clerk of Superior Court. | Sunset helps gather title, mortgage, heir and asset information so the family can choose between administration, a sale petition or the no-administration path with local counsel. |
