The jurisdiction process

  1. Collect the will, death certificate, asset list, debt list, names and addresses of heirs or beneficiaries, and any deed or account information needed for estate settlement.
  2. File the original will with the Rockdale County Probate Court with reasonable promptness if anyone has it, even if no one is asking to probate it (O.C.G.A. § 53-5-5). Rockdale County has a Petition for Will Filed, Not for Probate, and the court states there is no fee for that filing.
  3. Choose the correct Georgia petition. With a will, use common form or solemn form probate under O.C.G.A. § 53-5; common form does not become conclusive for four years from the order date (O.C.G.A. § 53-5-19). With no will, use letters of administration under O.C.G.A. § 53-6-20. Use the current statewide GPCSF form and any Rockdale County form that fits the issue.
  4. Email the completed petition to [email protected] if you want the court to quote the exact fee before filing. The statutory base fee for a decedent's-estate petition is $175.00 effective January 1, 2025, plus statutory add-ons including the $15.00 indigent defense fee effective January 1, 2025, and separate service and publication costs (O.C.G.A. § 15-9-60; O.C.G.A. § 15-21A-6).
  5. File on paper in person at 874 N. Main Street NW in Conyers during probate counter hours, or mail the packet to Post Office Box 289, Conyers, Georgia 30012. Rockdale County posts no probate e-filing option, and the original will, any codicil and any surety bond are always paper (Uniform Probate Court Rule 5.3.12(B)).
  6. Handle citation, service and publication. The court issues the citation, and the petitioner arranges service, acknowledgment or publication as required. Solemn form requires notice to heirs under O.C.G.A. § 53-5-22. If certified mail service is needed, Rockdale County charges $10.00 per certified mail service beginning July 14, 2024. Published probate notices run in the Rockdale Citizen, the county legal organ.
  7. Take the oath before the probate judge or a clerk. A notary cannot administer the oath. If the petitioner is outside Georgia, use GPCSF 53, Commission to Administer Oath, to take the oath before a court of record where the petitioner lives (O.C.G.A. § 53-6-24; GPCSF 1, instruction 11).
  8. Address bond. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50). Rockdale County's FAQ refers to a Consent of Heirs to Waiver of Bond, signed by all heirs and notarized.
  9. Receive letters testamentary or letters of administration after the court grants the petition and the petitioner qualifies. Certified copies of letters are $10.00 effective January 1, 2025 under O.C.G.A. § 15-9-60, so ask the court how many copies are practical for banks, title companies and transfer agents.
  10. Publish the notice to debtors and creditors within 60 days after qualification, once a week for four weeks in the Rockdale Citizen. Creditors who do not notify the personal representative within three months after the last publication lose equal participation rights as stated in O.C.G.A. § 53-7-41. The Rockdale Citizen rate card effective January 1, 2024 lists this four-week notice at $60.00.
  11. File the inventory with the Rockdale County Probate Court and mail a copy to heirs or beneficiaries within six months after qualification unless the duty is waived (O.C.G.A. § 53-7-30; O.C.G.A. § 53-7-32). Rockdale County publishes its own Estate Inventory form.
  12. Administer the estate, pay proper claims, make distributions, file required returns or fiduciary compliance reports, and close with GPCSF 33, Petition for Discharge of Personal Representative, when the estate is ready.

Georgia uses one statewide set of numbered probate forms, the GPCSF series. A document prepared on a standard form is acceptable in any Georgia probate court, and a court may decline to process a substitute that does not conform to the standard form (Uniform Probate Court Rule 5.9).
