Which court handles jurisdiction
The Thomas County Probate Court is the single probate filing office for Thomas County estates. File in Thomasville at 325 North Madison Street, by mail to P.O. Box 1582, Thomasville, GA 31799, or through TrueFiling where e-filing fits the filing.
Georgia has one probate court in every county and no probate circuits or districts. The jurisdiction process
- Find and secure the original will, if there is one. Whoever has the will must file it with the Thomas County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). If you e-file through TrueFiling, the original will and any codicil still must be delivered on paper within ten days of the electronic filing and before letters testamentary issue under Uniform Probate Court Rule 5.3.12(B).
- Choose the Georgia filing path and form. A will may be offered in common form or solemn form under O.C.G.A. § 53-5. If there is no will, use the appropriate letters of administration petition. If the heirs agree and the statutory conditions fit, an order that no administration is necessary is requested under O.C.G.A. § 53-2-40. - Take the oath before the Probate Judge or a probate clerk, not a notary (O.C.G.A. § 53-6-24). If the petitioner is outside Georgia, use GPCSF 53 for the oath to be administered by a court where the petitioner is located.

- Receive letters testamentary or letters of administration. These letters are the authority document the personal representative uses to collect assets, deal with institutions and manage estate settlement.
- Publish creditor notice after qualification. The personal representative publishes notice within 60 days of qualification, once a week for four weeks, in the Thomasville Times-Enterprise. Creditors who miss three months from the last publication lose equal participation as stated in O.C.G.A. § 53-7-41.
- Inventory, administer and close. Unless waived, the personal representative files and mails the inventory within six months under O.C.G.A. § 53-7-30 and O.C.G.A. § 53-7-32. Pay valid claims, distribute property, file any required fiduciary compliance reports, and use GPCSF 33 when it is time to ask for discharge.
