The jurisdiction process

  3. Choose the petition and form. With a will, use solemn form or common form probate (O.C.G.A. § 53-5-15). Common form does not become conclusive for four years from the order admitting the will (O.C.G.A. § 53-5-19). With no will, use the letters of administration path (O.C.G.A. § 53-6-20). Use the current GPCSF form or a document that meets Uniform Probate Court Rule 5.9.
  4. If you are filing without an attorney, complete the Lowndes County self-represented step. Review the court's self-represented litigant packet and file the signed affidavit with the petition. The affidavit is sworn before a clerk of the Probate Court.
  5. Pay at filing. The statutory base fee for a decedent estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60, plus statutory add-ons, service costs and publication costs. Confirm the current total with the court. The court's 2025 payment instructions allow Visa, MasterCard, Discover, money order, cashier's check and cash in bills no larger than $20, with no card payments after 4:15 p.m.
  6. Handle citation, service and publication. The court issues the citation, and the petitioner handles service, acknowledgments or publication as required. Solemn form requires notice to heirs (O.C.G.A. § 53-5-22). Published citations in Lowndes County run in the Valdosta Daily Times.
  7. Take the oath and address bond. Before letters issue, the petitioner must take the oath before the probate judge or a clerk, not before a notary (O.C.G.A. § 53-6-24; GPCSF 1 instruction 11). An out-of-state petitioner can use GPCSF 53 to take the oath before a court of record where they live. An administrator of an intestate estate or a temporary administrator gives bond unless it is waived by unanimous heir consent (O.C.G.A. § 53-6-50). The original surety bond is delivered on paper.
  8. Receive authority. Once the court admits the will or appoints the administrator, qualifies the personal representative and completes any required bond step, it issues letters testamentary or letters of administration. Ask the court how many certified copies you need for banks, title companies and other institutions.
  9. Publish creditor notice. The personal representative must publish notice to creditors within 60 days of qualification, once a week for four weeks, in the Valdosta Daily Times. Creditors have three months from the last publication to notify the personal representative under O.C.G.A. § 53-7-41. A creditor filing a claim in a Lowndes County estate pays $15.00 under the court's 2025 estate claims sheet.
  10. Administer and close the estate. File the inventory with the Lowndes County Probate Court and mail required copies within six months unless waived (O.C.G.A. §§ 53-7-30 and 53-7-32). Use the court's estate inventory and return instructions, pay claims, distribute property and petition for discharge on GPCSF 33 when administration is complete.
