Before you begin — know the assets and liabilities

Before you file in Heard County, list the assets, debts, heirs, beneficiaries, title paperwork and any original will. Georgia probate turns on what was owned in the decedent's name, whether land is involved, whether heirs agree, and whether a personal representative needs letters testamentary or letters of administration.

Sunset's estate settlement tools help families find accounts across more than 2,300 financial institutions, organize liabilities and decide what must go into the Heard County probate packet. That asset picture should come before you choose common form, solemn form, letters of administration, year's support under O.C.G.A. § 53-3, or a petition for an order that no administration is necessary under O.C.G.A. § 53-2-40.

Which court handles jurisdiction

The Heard County Probate Court in Franklin serves all of Heard County, including Franklin and the unincorporated communities across the rest of the county. Georgia has one Probate Court in each county, so a Heard County estate is filed with the Heard County Probate Court and not with a separate district office.

For estate administration, venue is in the county where the decedent lived at death, or for a nonresident of Georgia, in a county where the decedent owned property or had a cause of action (O.C.G.A. § 15-9-31). If the family is using a petition for an order that no administration is necessary, the filing belongs in the county of the decedent's Georgia domicile, or in the county where the real property is located if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).

A party seeking review of a Heard County Probate Court decision files a petition for review in the superior court within 30 days of the judgment (O.C.G.A. § 5-3-7(b)). That review is de novo, with the jury right preserved (O.C.G.A. § 5-3-5(d)).

The jurisdiction process

  1. Start with the original will and the asset list. Whoever holds the will must file it with the Heard County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). There is no Georgia rule requiring filing within a fixed number of days.
  2. Choose the Georgia petition. With a will, use common form or solemn form probate under O.C.G.A. § 53-5. Common form does not become conclusive for four years from the date of the order admitting the will (O.C.G.A. § 53-5-19). With no will, use the petition for letters of administration under O.C.G.A. § 53-6-20.
  3. Prepare the statewide forms. Use the GPCSF form that matches the estate path. Heard County does not list a county probate cover sheet or packet.
  4. File on paper in Franklin or by mail. File at the Heard County Probate Court, 215 East Court Square, Room 3, Franklin, GA 30217, or mail the packet to P.O. Box 478, Franklin, GA 30217. No estate e-filing is listed for Heard County.
  5. Pay the filing cost. Georgia sets a $175.00 base filing fee for a decedent's-estate petition under O.C.G.A. § 15-9-60, effective January 1, 2025, plus statutory add-ons and separate service and publication costs. Call the court at (706) 675-3353 to confirm the current total before filing.
  6. Handle citation, service and publication. The court issues the citation, and the petitioner arranges service, acknowledgment or publication. Published notices for Heard County run in The News and Banner, Franklin, the county's legal organ.
  7. Take the oath and address bond. The petitioner takes the oath before the Heard County probate judge or a clerk, not a notary. An out-of-state petitioner can use GPCSF 53. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50).
  8. Receive authority from the court. After the court approves the petition and the personal representative qualifies, the court issues letters testamentary or letters of administration.
  9. Publish creditor notice and administer the estate. The personal representative must publish notice to creditors within 60 days after qualification, once a week for four weeks, in the county's official newspaper. Creditors who do not notify the personal representative within three months after the last publication lose equal participation (O.C.G.A. § 53-7-41).
  10. Inventory, pay claims and close. Unless waived, file the inventory with the court and mail it to heirs or beneficiaries within six months after qualification (O.C.G.A. § 53-7-30, O.C.G.A. § 53-7-32). Then pay valid claims, distribute property, file required fiduciary compliance reports and petition for discharge on GPCSF 33.

Forms and documents

Probate forms in Heard County

Georgia uses one statewide set of numbered probate forms, the GPCSF series, adopted by the Council of Probate Court Judges and approved by the Supreme Court of Georgia. A document prepared on a standard form is acceptable in any Georgia probate court, and a court may decline to process a substitute that does not conform to the standard form under Uniform Probate Court Rule 5.9.

Heard County does not list its own probate cover sheet, checklist or estate packet. Use the statewide GPCSF forms, then file the completed paper packet with the Heard County Probate Court at 215 East Court Square, Room 3, Franklin, GA 30217, or mail it to P.O. Box 478, Franklin, GA 30217.

Scenarios

PersonaPath in Heard CountyWhere Sunset helps
Surviving spouse with co-owned homeIf the home was held with survivorship or an account has a beneficiary designation, that asset may pass outside the estate. If property was in the decedent's sole name, the spouse files paper forms with the Heard County Probate Court. Year's support under O.C.G.A. § 53-3 can set aside property, including a family home, and must be filed within 24 months of death (O.C.G.A. § 53-3-5).Sunset helps identify title, accounts, debts and beneficiary assets so the spouse does not open a broader estate than needed.
Out-of-state adult child with small estateNo estate e-filing is listed for Heard County, so the petition and any original will go to Franklin on paper by mail or in person. The oath cannot be notarized. The child can travel to Franklin or use GPCSF 53 to swear before a court of record at home. If the estate is limited to a bank deposit, ask the financial institution about direct payment under O.C.G.A. § 7-1-239 before opening a court case.Sunset helps collect account information, organize the packet and flag when a non-court transfer may solve part of the estate settlement.
Parent settling predeceased child's estate, home must be soldSelling a house usually requires authority from the Heard County Probate Court. A personal representative may seek expanded powers under O.C.G.A. § 53-7-1(b) using GPCSF 32, or file GPCSF 13 for leave to sell. If there is no will, all heirs agree, and the estate owes nothing or creditors consent, a petition for an order that no administration is necessary can vest title with no dollar limit (O.C.G.A. § 53-2-40).Sunset helps map heirs, debts and property, then helps decide whether the family needs letters, a sale petition, or an attorney for the land issue.

When to hire an attorney

You can file a Georgia probate petition without a lawyer, but counsel often makes sense in Heard County when land or farm acreage must be sold or divided, heirs disagree, a caveat is filed, creditors are a problem, or someone is considering a petition for review in the superior court under O.C.G.A. § 5-3-7(b), a de novo proceeding under O.C.G.A. § 5-3-5(d). Sunset connects families to a vetted attorney.
