Before you begin — know the assets and liabilities
Before you file in Dooly County, identify what the decedent owned, how each asset was titled, what debts exist, and whether any account has a beneficiary designation. That determines whether estate settlement needs letters testamentary, letters of administration, year's support, or another Georgia path.
Sunset's asset discovery searches more than 2,300 financial institutions and helps families organize accounts, real estate, debts and contact information before they call the Dooly County Probate Court or mail a petition to Vienna.
Which court handles jurisdiction
The Dooly County Probate Court in Vienna serves the entire county, including Vienna, Unadilla and the unincorporated communities across Dooly County. Georgia has one probate court in every county, and a Dooly County estate is filed with this Probate Court, not with a county clerk or a district office.
Administration may be granted only on the estate of someone who lived in Dooly County at death, or on the estate of a nonresident of Georgia who owned property in Dooly County or had a cause of action here (O.C.G.A. § 15-9-31). If the filing is a petition for an order that no administration is necessary, venue follows O.C.G.A. § 53-2-40.
A party seeking review of a Dooly County Probate Court decision files a petition for review in the superior court within 30 days of the judgment (O.C.G.A. § 5-3-7(b)). The superior court review is de novo with the jury right preserved (O.C.G.A. § 5-3-5(d)).
The jurisdiction process
- Find and file the original will, if there is one. Whoever holds the will must file it with the Dooly County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). Georgia does not set a numeric deadline for this filing.
- Choose the correct statewide GPCSF petition. With a will, probate may be in common form or solemn form under O.C.G.A. § 53-5. Common form does not become conclusive for four years from the date of the order admitting the will under O.C.G.A. § 53-5-19. With no will, the usual petition is for letters of administration under O.C.G.A. § 53-6-20.
- File on paper with the Dooly County Probate Court. Deliver papers to 104 S. Second Street, Vienna, GA 31092, or mail them to P.O. Box 304, Vienna, GA 31092. The original will and any codicil must be delivered on paper under Uniform Probate Court Rule 5.3.12(B).
- Pay the filing fee at filing. The base fee for a decedent's-estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60, plus statutory add-ons, service and publication. Call (229) 268-4217 to confirm the current total before filing.
- Complete notice and service. The court issues the citation, and the petitioner arranges service, acknowledgment, or publication as required. Published probate notices in Dooly County run in The News Observer in Vienna, the county's legal organ.
- Take the oath correctly. Before letters issue, the petitioner takes the oath before the Dooly County probate judge or a clerk of the court, not before a notary. An out-of-state petitioner may use GPCSF 53 to take the oath before a court of record outside Georgia.
- Address bond. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50). If expanded powers or waivers are needed, the personal representative may use the Georgia procedure under O.C.G.A. § 53-7-1(b) and GPCSF 32.
- Receive authority from the court. After the court admits the will or appoints the administrator, letters testamentary or letters of administration give the personal representative authority to act for the estate.
- Publish the creditor notice. The personal representative must publish notice to creditors within 60 days of qualification, once a week for four weeks, in the official newspaper of the county. Creditors who do not notify the personal representative within three months of the last publication lose equal participation as provided in O.C.G.A. § 53-7-41.
- Inventory, administer and close the estate. File the inventory with the court and mail a copy to heirs or beneficiaries within six months of qualification unless waived (O.C.G.A. § 53-7-30, O.C.G.A. § 53-7-32). Then pay claims, distribute property, file required fiduciary compliance reports and petition for discharge on GPCSF 33 when the estate is ready to close.

Scenarios
| Situation | Likely Dooly County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | Property held with survivorship or a beneficiary designation may pass outside probate. If the home or accounts were in the decedent's sole name, file the appropriate statewide GPCSF petition with the Dooly County Probate Court. Year's support under O.C.G.A. § 53-3 can set aside property, including a family home, and must be filed within 24 months of death under O.C.G.A. § 53-3-5. | Sunset helps identify account ownership, beneficiary designations, debts and real property details before the spouse chooses an estate settlement path. |
| Out-of-state adult child with small estate | Plan for paper filing by mail or in person. The petition and original will, if any, go to the Dooly County Probate Court in Vienna. The oath cannot be notarized, so an out-of-state petitioner either travels to Vienna or uses GPCSF 53 before a court of record where the petitioner lives. | Sunset organizes the asset list, heirs, addresses and form information so the child can avoid repeated calls and mailings during estate settlement. |
| Parent settling predeceased child's estate, home must be sold | Selling a house usually requires authority from the Dooly County Probate Court. A personal representative may seek expanded powers under O.C.G.A. § 53-7-1(b) on GPCSF 32 or petition for leave to sell on GPCSF 13. If there is no will, all heirs agree, and debts are resolved, a petition for an order that no administration is necessary under O.C.G.A. § 53-2-40 can vest title in the heirs, and an order affecting Dooly County land is recorded in the deed records. | Sunset helps assemble deeds, mortgage information, heirs, creditor details and attorney options before the family asks the court for sale authority. |
