Smyth County estates are handled at the Smyth Circuit Court clerk's counter in Marion. Smyth County is in the Twenty-eighth Judicial Circuit and has its own Clerk of the Circuit Court, its own courthouse, and its own Virginia Judiciary court page.

Virginia venue starts in the circuit court of the county or city where the decedent had a known place of residence (Va. Code § 64.2-443). The jurisdiction process

  7. Work with the commissioner of accounts after qualification. The inventory goes to the commissioner of accounts, not the clerk, and the first account is due within 16 months of qualification under Va. Code § 64.2-1304.
  8. Administer, distribute and close the estate through the commissioner of accounts process. Estate settlement in Virginia usually ends when the required account or statement in lieu is accepted and the estate's remaining work is complete.
