Before you begin — know the assets and liabilities

Before you call the Brunswick County clerk, make a working list of the decedent's probate assets, debts, real estate, beneficiaries and heirs. The clerk can tell you what to bring to the Lawrenceville appointment, but the clerk cannot build the asset picture for you.

Sunset's estate settlement workflow can help by checking more than 2,300 institutions for accounts and assets, organizing what is found, and turning that information into a cleaner probate packet for the Brunswick County appointment.

Which court handles jurisdiction

File in Brunswick County when the decedent had a known place of residence in Brunswick County. Virginia's venue rule sends a will to the circuit court of the county or city where the decedent had a known place of residence (Va. Code § 64.2-443). If the decedent had moved to a nursing home or similar facility because of age or impaired health, Virginia law presumes the prior legal residence continues unless that presumption is rebutted.

Brunswick County has its own Clerk of the Circuit Court and its own courthouse in Lawrenceville. It is in the Sixth Judicial Circuit, and no shared-clerk arrangement applies here.

The jurisdiction process

  1. Gather the original will, death certificate, names and addresses of heirs and beneficiaries, asset information, debt information, and any bond or nonresident fiduciary paperwork that may apply.
  2. Call the Brunswick County Clerk of the Circuit Court at (434) 848-2215 to ask what the clerk wants you to bring to the Lawrenceville appointment and whether any local scheduling rule applies.
  3. Complete the statewide Virginia fiduciary forms that fit the estate, including the probate information form, list of heirs, probate tax return when required, and nonresident fiduciary consent if the personal representative lives outside Virginia.
  4. Take the original will, completed forms and payment to the clerk's office at 216 North Main Street in Lawrenceville. In Virginia, the clerk may admit the will and qualify the personal representative at the clerk's counter (Va. Code § 64.2-444).
  5. Pay the state probate tax and clerk charges that apply. State probate tax is 10 cents per $100 of value for estates over $15,000 under Va. Code § 58.1-1712, unchanged since 2003, and the clerk should quote any optional local probate tax authorized by Va. Code § 58.1-1718 before you pay.
  6. After qualification, use the certificate of qualification to deal with banks, transfer agents and other institutions. If the clerk issues a certificate of qualification, institutions presented with a currently effective certificate have acceptance duties under Va. Code § 64.2-520.2.
  7. Send required notice of probate to the people entitled to notice within 30 days after qualification or admission of the will, then record the notice affidavit within four months as required by Va. Code § 64.2-508.
  8. Work with the Brunswick commissioner of accounts, whose contact information is available through the Virginia Judiciary directory. The inventory and accounts go to the commissioner of accounts, not to the clerk. The inventory is due within four months after the order of qualification under Va. Code § 64.2-1300, and the first account is due within 16 months under Va. Code § 64.2-1304.
  9. Finish administration, resolve claims and distributions, and close the estate settlement through the commissioner of accounts. If the estate qualifies for a statement in lieu of account, use the statewide statement in lieu process instead of a full account when Virginia law permits it.

Frequently asked questions

Where do I file to probate a will in Brunswick County?

File with the Clerk of the Circuit Court at the Brunswick Circuit Court, 216 North Main Street, Lawrenceville, VA 23868. Virginia venue is based on the county or city where the decedent had a known place of residence (Va. Code § 64.2-443).

Do I have to go before a judge to be appointed in Brunswick County?

No. In Virginia, the clerk may admit the will and qualify the personal representative at the clerk's counter (Va. Code § 64.2-444). A judge becomes involved only if a dispute, appeal or other judge-side matter requires it.

Does the Brunswick County clerk's office have its own probate forms?

No Brunswick-specific probate packet, worksheet or checklist is published. Use the statewide Virginia Circuit Court fiduciary forms and call the clerk at (434) 848-2215 to ask what the office wants completed before your appointment.

Can I file Brunswick County probate papers through VJEFS?

Not for qualification before the clerk. Brunswick participates in VJEFS, but VJEFS is for Virginia State Bar members and their designated staff in eligible matters. A self-represented personal representative should expect to work directly with the clerk's office.

Can I review a Brunswick County estate file from home?

There is no free public portal for Brunswick County estate files. The clerk publishes a paid secure remote records subscription for registered users that includes wills and fiduciary filings, and the clerk's office provides the fee and credential procedure.

What will it cost to probate a will in Brunswick County?

The statewide probate tax is 10 cents per $100 of value for estates over $15,000 under Va. Code § 58.1-1712, unchanged since 2003, and qualification and recording charges follow Va. Code § 17.1-275. A county may add an optional one-third local probate tax under Va. Code § 58.1-1718, so ask the Brunswick clerk to quote the total before your appointment.

Do I have to come to Lawrenceville in person?

No Brunswick County page publishes a remote qualification option. Because qualification is handled by the clerk rather than through an ordinary civil hearing, plan on a clerk appointment in Lawrenceville unless the clerk tells you another method is available.

Where do I send the inventory and accounts after I qualify?

Send the inventory and accounts to the commissioner of accounts assigned for Brunswick County, not to the clerk. The inventory is due within four months after qualification under Va. Code § 64.2-1300, and the first account is due within 16 months under Va. Code § 64.2-1304.
