Which court handles jurisdiction

Campbell County probate is handled at the Campbell Circuit Court clerk's counter, 732 Village Highway in Rustburg. Campbell County has its own elected Clerk of the Circuit Court in the Twenty-fourth Judicial Circuit.

Virginia venue is based on the decedent's known place of residence. A will is offered for probate in the circuit court of the county or city where the decedent had a known place of residence, and a nursing home stay does not automatically change that residence (Va. Code § 64.2-443). For a Campbell County resident, start at the Rustburg clerk's office.

The jurisdiction process

  1. Collect the will, death certificate, asset list, debt list and names and addresses of heirs and beneficiaries. If there is no will, be ready to explain who is entitled to qualify as administrator.
  2. Call the Campbell County Clerk of the Circuit Court at (434) 592-9517 before going to 732 Village Highway in Rustburg. Ask what the clerk wants you to bring for a probate or qualification appointment.
  3. Use the statewide Virginia Circuit Court forms. Campbell County does not publish a county-specific probate packet or cover sheet.
  4. At the clerk's counter, offer the will for probate if there is one and qualify, Virginia's word for being appointed and sworn in, if a personal representative is needed. In Virginia, the clerk may admit the will and qualify an executor or administrator (Va. Code § 64.2-444).
  5. Pay the charges collected at the counter. State probate tax is 10 cents per $100 of value for estates above $15,000 under Va. Code § 58.1-1712, current as of August 2026. Campbell County imposes the local probate tax at one-third of the state tax under Va. Code § 58.1-1718 and Campbell County Code § 9-2.2, current as of August 2026. The qualification fee is set by Va. Code § 17.1-275(A)(3), effective July 1, 2022.
  6. Receive the certificate of qualification, the Virginia authority document used to deal with banks, transfer agents and buyers. The statewide certificate form is CC-1625.
  7. Send the required notice of probate or qualification to heirs and beneficiaries within 30 days, then record the affidavit of notice with the clerk within four months (Va. Code § 64.2-508).
  8. Do not wait for a routine opening hearing. A contested matter may be set for the Circuit Court, and remote participation in a civil proceeding is discretionary when authorized by the court (Va. Code § 17.1-513.2). No Campbell County remote qualification practice is published.
  9. After qualification, work with the commissioner of accounts assigned to the estate. Campbell County is served by two commissioner of accounts offices in Rustburg. Return the inventory to the commissioner within four months after the order of qualification (Va. Code § 64.2-1300), and file the first account with the commissioner within 16 months under Va. Code § 64.2-1304 unless a valid alternative applies.
  10. Finish administration, pay claims and expenses in the proper order, distribute what remains, and close the estate through the commissioner of accounts. Estate settlement is complete only after the required account or closing statement is accepted through the Virginia fiduciary process.

Fees

Campbell County has imposed local charges that sit on top of the statewide Virginia probate tax and clerk fees. State probate tax is 10 cents per $100 of value for estates above $15,000 under Va. Code § 58.1-1712, current as of August 2026. Campbell County Code § 9-2.2 imposes the local probate tax at one-third of the state tax under Va. Code § 58.1-1718, current as of August 2026.

Campbell County Code § 9-2.2 also imposes a local $25 fee, current as of August 2026, for recording a list of heirs under Va. Code § 64.2-509 or a real estate affidavit under Va. Code § 64.2-510. That local charge is in addition to the state fee authorized by Va. Code § 58.1-1717.1.
