Which court handles jurisdiction

Lunenburg County probate matters are handled by the Clerk of the Circuit Court at 11435 Courthouse Road in Lunenburg. The county seat community is Lunenburg, also called Lunenburg Court House, and the incorporated towns of Kenbridge and Victoria are in the county.

Virginia's venue rule sends a will to the circuit court of the county or city where the decedent had a known place of residence (Va. Code § 64.2-443). If a Lunenburg County resident died while living temporarily in a nursing home or similar institution somewhere else, Virginia law presumes the legal residence stayed where it was before the move unless that presumption is rebutted.

Lunenburg County is in the Tenth Judicial Circuit. Sharing a circuit does not mean sharing a clerk. Lunenburg County has its own clerk's office at the Lunenburg courthouse.

The jurisdiction process

  1. Collect the original will, death certificate, asset list, debt list, names and addresses of heirs and beneficiaries, and any beneficiary designations. If the estate may fit the small-asset affidavit route, remember that the $75,000 ceiling is effective July 1, 2025 and comes from Va. Code §§ 64.2-600 through 64.2-601.
  2. Call the Lunenburg Circuit Court clerk at (434) 696-2132 before going to 11435 Courthouse Road. The clerk publishes general office hours, but not a probate appointment policy or an intake cutoff.
  3. Prepare the statewide Virginia fiduciary forms that apply, including CC-1650, CC-1651 if a probate tax return is needed, CC-1611 for the list of heirs, CC-1610 for a nonresident fiduciary, and any will-proof forms the clerk requests.
  4. Offer the will, if there is one, and qualify before the Clerk of the Circuit Court if a personal representative is needed. In Virginia, qualification is the word for being appointed and sworn in, and the clerk may admit wills and qualify personal representatives under Va. Code § 64.2-444.
  5. Pay the state probate tax, qualification charge and recording charge that apply. State probate tax is 10 cents per $100 under Va. Code § 58.1-1712, with estates of $15,000 or less exempt since 2003. Qualification and recording charges are set by Va. Code § 17.1-275, effective July 1, 2022. Ask the clerk whether Lunenburg County adds the optional local probate tax under Va. Code §§ 58.1-1718 and 58.1-3805.
  6. Receive the certificate of qualification, CC-1625, if the clerk qualifies you as personal representative. Financial institutions use that certificate to recognize your authority.
  7. Send the required notice of probate or qualification to the people entitled to notice, then record the affidavit of notice with the clerk within the statutory period required by Va. Code § 64.2-508.
  8. Work with the commissioner of accounts after qualification. The Lunenburg commissioner is found through the Virginia Judiciary directory and is listed with an office in Kenbridge. Return the inventory to the commissioner within four months after qualification under Va. Code § 64.2-1300, and file the first account within 16 months under Va. Code § 64.2-1304.
  9. Handle creditor questions, sales, distributions and closing through the commissioner of accounts. A judge is not part of opening an ordinary estate, but contested matters or appeals can move to the circuit court under Va. Code §§ 64.2-445, 64.2-446 and 64.2-448.
