  5. Pay the taxes and fees the clerk calculates. The state probate tax is imposed by Va. Code § 58.1-1712. Appomattox County has also imposed a county tax equal to one third of the state probate tax under Va. Code § 58.1-1718 and Appomattox County Code §§ 3.7-8 and 3.7-9. Recording and qualification fees are statutory.
  6. Receive the certificate of qualification if you qualify. The certificate of qualification is the Virginia authority document that lets the personal representative deal with institutions (Va. Code § 64.2-506; CC-1625).
  7. Send required notice after probate or qualification. Notice to heirs and beneficiaries is due within 30 days after qualification or admission of the will, and the affidavit of notice is recorded within four months (Va. Code § 64.2-508; CC-1616 and CC-1617).
  8. Work with the commissioner of accounts. Appomattox has two commissioners of accounts listed for the county. The inventory goes to the commissioner within four months after the order conferring authority (Va. Code § 64.2-1300; CC-1670), and the first account is due within 16 months from qualification (Va. Code § 64.2-1304; CC-1680).
  9. Address creditor issues and closing. Creditor publication is optional in Virginia under Va. Code § 64.2-508.1. Depending on the estate, the personal representative may use a debts and demands process, a show cause order, an account, or a statement in lieu to move the estate settlement toward closing.
