Which court handles jurisdiction

Cumberland County estates are opened at the Clerk of the Circuit Court's counter at 1 Courthouse Circle in the town of Cumberland. A will is offered for probate in the circuit court of the county or city where the decedent had a known place of residence (Va. Code § 64.2-443). If the decedent became a patient in a nursing home or similar institution because of advanced age or impaired health, Virginia law presumes the legal residence stayed where it was before that move unless the presumption is rebutted.

Cumberland County is in the Tenth Judicial Circuit with Appomattox, Buckingham, Charlotte, Halifax, Lunenburg, Mecklenburg and Prince Edward counties (Va. Code § 17.1-506). Cumberland has its own clerk's office and courthouse in Cumberland.

The jurisdiction process

  1. Call the Cumberland Clerk of the Circuit Court at (804) 492-4442 to schedule the probate or qualification appointment. The county page says to bring the original will, a copy of the death certificate and an estimate of the decedent's total asset value.
  2. At the appointment, present the will if there is one and ask to qualify as personal representative if authority is needed. In Virginia, qualification means being appointed and sworn in by the clerk (Va. Code § 64.2-444).
  3. Pay the state probate tax and clerk charges that apply. State probate tax is 10 cents per $100 of value, with estates of $15,000 or less exempt, unchanged since July 1, 2003 (Va. Code § 58.1-1712). A county may impose a local probate tax equal to one-third of the state probate tax (Va. Code § 58.1-1718), so ask the clerk for the total when you schedule.
  4. If you are a nonresident personal representative, be ready to sign the Consent of Nonresident Fiduciary for Service of Process, CC-1610, and discuss any surety requirement with the clerk (Va. Code §§ 64.2-1426, 64.2-1411).
  5. After qualification, obtain certified copies of the certificate of qualification, CC-1625. This is the document banks and other institutions use to recognize your authority (Va. Code § 64.2-506).
  6. Send the required notice of probate or qualification to the people entitled to notice within 30 days, then record the affidavit of notice with the clerk within four months (Va. Code § 64.2-508).
  7. Work with the commissioner of accounts, whose office for Cumberland matters is in Farmville. Return the inventory to the commissioner within four months after the order conferring authority, and file the first account within 16 months of qualification (Va. Code §§ 64.2-1300, 64.2-1304).
  8. Administer the estate, address creditor issues if they arise, distribute when it is proper to do so and close the estate settlement through the commissioner of accounts.
