Before you begin — know the assets and liabilities
Before you call the Shenandoah County clerk, make a working list of the decedent's assets, debts, real estate, account statements, vehicle titles, beneficiaries, and heirs. Virginia probate turns on what property actually needs a personal representative, so a little asset work before the appointment can prevent extra trips to Woodstock.
Sunset's estate settlement tools help families search more than 2,300 financial institutions for accounts, organize liabilities, and prepare a cleaner probate packet before the clerk appointment.
Which court handles jurisdiction
For a Shenandoah County resident, probate is handled by the Clerk of the Circuit Court at 112 South Main Street in Woodstock. A will is offered for probate in the circuit court of the county or city where the decedent had a known place of residence (Va. Code § 64.2-443). If the person moved to a nursing home or similar institution because of age or health, Virginia presumes the legal residence stayed where it was before that move unless someone proves otherwise (§ 64.2-443).
Shenandoah County is in the Twenty-sixth Judicial Circuit with other counties and independent cities, but Shenandoah County has its own clerk's office. Do not assume that a shared judicial circuit means a shared probate counter.
The jurisdiction process
- Sort the estate before you schedule. Identify the will, death certificate, heirs, beneficiaries, Shenandoah County real estate, bank accounts, debts, and assets that may pass outside probate.
- Call the clerk's office in Woodstock. Use (540) 459-6150 to ask how the clerk wants probate appointments scheduled and what documents to bring to 112 South Main Street.
- Prepare the opening documents. Bring the original will if there is one, the death certificate, heir and beneficiary information, CC-1650 Probate Information Form, CC-1611 List of Heirs, and CC-1651 Probate Tax Return if the estate exceeds $15,000 (Va. Code § 58.1-1712, rate unchanged since 2003).
- Qualify before the clerk. Qualification is Virginia's word for being appointed and sworn in as personal representative. The clerk may admit the will and qualify an executor or administrator without a judge under Va. Code § 64.2-444.
- Pay the tax and receive authority. The Commonwealth's probate tax is 10 cents per $100 on estates over $15,000 (Va. Code § 58.1-1712, rate unchanged since 2003). A county may add a local probate tax equal to one-third of the state tax (Va. Code § 58.1-1718), so confirm the total with the clerk when you make your appointment. After qualification, ask for certified copies of CC-1625, the certificate of qualification.
- Give probate notice. Within 30 days after qualification or admission of the will, send CC-1616 Notice Regarding Estate to the people entitled to notice, then record CC-1617 Affidavit of Notice Regarding Estate within four months (Va. Code § 64.2-508).
- Work with the commissioner of accounts. The commissioner of accounts, not the clerk, supervises inventories and accounts. Return CC-1670 Inventory of Decedent's Estate to the commissioner within four months after the order conferring authority, and submit the first CC-1680 account within 16 months of qualification (Va. Code §§ 64.2-1300, 64.2-1304).
- Administer and close the estate. Pay valid expenses and claims, manage or sell estate property when authority exists, distribute remaining assets, and close through the commissioner of accounts. Some estates can use CC-1681 Statement in Lieu of Settlement of Account, which can make estate settlement simpler when the statutory conditions are met.

Scenarios
| Scenario | Likely Shenandoah County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | Confirm how the home is titled, identify any assets that still require a personal representative, and call the Woodstock clerk before bringing the will, death certificate, and heir information. If probate is opened, the clerk handles qualification and the commissioner of accounts supervises later filings. | Sunset helps find accounts, organize title information, and prepare the estate settlement checklist before the clerk appointment. |
| Out-of-state adult child with small estate | If the personal probate estate is $75,000 or less, the Small Estate Affidavit route may avoid qualification for qualifying personal property (Va. Code §§ 64.2-600 through 64.2-601, effective July 1, 2025). If you do qualify from out of state, expect to sign CC-1610 for service of process and discuss surety with the clerk (Va. Code § 64.2-1426). | Sunset helps decide which accounts need action, generate the right starting packet, and connect you with a Virginia probate attorney if travel or surety issues make the estate harder. |
| Parent settling predeceased child's estate, home must be sold | Call the Shenandoah County clerk to schedule the probate appointment and ask what authority will be needed to sell the home. If a personal representative qualifies, later inventory and accounting work goes through the commissioner of accounts, not the clerk. | Sunset helps gather asset and debt information, prepare questions for the clerk and commissioner, and connect the family with a local probate attorney for sale authority and title issues. |

Frequently asked questions
Where do I file probate for a Shenandoah County resident?
Start with the Clerk of the Circuit Court at 112 South Main Street in Woodstock. Virginia venue is the circuit court of the county or city where the decedent had a known place of residence (Va. Code § 64.2-443).
Does Shenandoah County have a separate probate court?
No. Virginia probate is handled by the Clerk of the Circuit Court. The clerk may admit the will and qualify the personal representative under Va. Code § 64.2-444.
Do I need an appointment with the Shenandoah County clerk?
Call (540) 459-6150 before going to the courthouse. Probate appointments take time, and the clerk can tell you what documents to bring and how it wants the appointment scheduled.
Can I open a Shenandoah County estate through an online filing system?
Plan on a clerk appointment and paper probate documents. Virginia's attorney electronic filing system is for most civil circuit matters, and it is not a self-represented probate-qualification system.
Can I see Shenandoah County estate papers on a public website?
Virginia's public case-information systems do not provide a free estate-file search for probate files. Ask the Shenandoah County clerk about in-person will-book access and any paid secure remote access it offers.
What probate forms should I start with in Shenandoah County?
Start with statewide Virginia circuit court forms, especially CC-1650, CC-1651 when the estate exceeds $15,000 under Va. Code § 58.1-1712, CC-1611, and any will-proof or qualification forms the clerk requests. Ask the clerk whether it wants any local cover sheet.
How much is the Shenandoah County probate tax?
The Commonwealth's probate tax is 10 cents per $100 on estates over $15,000 (Va. Code § 58.1-1712, rate unchanged since 2003). A county may add a local probate tax equal to one-third of the state tax (Va. Code § 58.1-1718), so confirm the total with the clerk when you make your appointment.
Do I have to travel to Woodstock if I live out of state?
Qualification is handled through the clerk's office in Woodstock, so call before making travel plans. A nonresident personal representative can serve, but must file CC-1610 consent for service of process and should expect to discuss surety with the clerk (Va. Code § 64.2-1426).
