Which court handles jurisdiction
Page County estates are handled at the Page Circuit Court clerk's office in Luray. Page County is part of the Twenty-sixth Judicial Circuit with the Cities of Harrisonburg and Winchester and the Counties of Clarke, Frederick, Page, Rockingham, Shenandoah and Warren, but Page County keeps its own clerk's counter and courthouse.
Virginia venue is based on the decedent's known place of residence. A will is offered for probate in the circuit court of the county or city where the decedent had that residence, so a Page County resident's estate is opened with the Clerk of the Circuit Court in Luray (Va. Code § 64.2-443). If the decedent moved to a nursing home or similar facility because of age or health, Virginia law presumes the prior legal residence continues unless that presumption is rebutted (§ 64.2-443).
The jurisdiction process
- Gather the original will, death certificate, addresses for heirs and beneficiaries, asset information, debt information and any real estate details before you contact the Page County clerk.

- Pay the state probate tax and clerk charges that apply. The state probate tax is 10 cents per $100 of estate value, with estates of $15,000 or less exempt, under Va. Code § 58.1-1712, current since July 1, 2003. Because a county may add a local probate tax under Va. Code §§ 58.1-1718 and 58.1-3805, ask the Page County clerk for the total.
- After qualification or admission of the will, send the required notice of probate to the people entitled to notice within 30 days, then record the notice affidavit with the clerk within four months (Va. Code § 64.2-508).
- Do not wait for a court term or motion day to open the estate. Qualification is handled by the clerk, not on a judge's calendar. If a contested civil hearing is later scheduled, remote participation is only at the court's discretion under Va. Code § 17.1-513.2.
- Use the certificate of qualification to deal with banks, buyers and institutions, then administer the estate. File the inventory with the commissioner of accounts within four months after qualification, and file the first account with the commissioner within 16 months under Va. Code §§ 64.2-1300 and 64.2-1304, unless a proper statement in lieu or other Virginia rule applies.
