Virginia venue is based on the decedent's known place of residence. A will is offered and a personal representative qualifies in the circuit court of the county or city where the decedent had a known place of residence, with fallback rules for Virginia real estate, place of death or estate property if there is no known residence (Va. Code § 64.2-443). If a person died while living in a nursing home or similar institution, the prior legal residence is rebuttably presumed to remain the residence for venue purposes (§ 64.2-443).

The jurisdiction process

  1. Call the Grayson Circuit Court clerk at (276) 773-2231 before going to 129 Davis Street in Independence. Ask whether the clerk wants an appointment, what documents to bring, how many certified certificates of qualification you should request, and whether any Grayson County local probate tax under Va. Code § 58.1-1718 is included in the total.
  2. Prepare the statewide forms that fit the situation. Common starting forms include CC-1650 Probate Information Form, CC-1651 Probate Tax Return when required by Va. Code § 58.1-1714, CC-1611 List of Heirs, and CC-1610 Consent of Nonresident Fiduciary for Service of Process if the personal representative lives outside Virginia.
  3. Go to the clerk's office to offer the will, if there is one, and qualify as executor or administrator if qualification is needed. In Virginia, the Clerk of the Circuit Court or a deputy clerk may admit wills to probate and qualify personal representatives with the same effect as the circuit court (Va. Code § 64.2-444).
  4. Pay the probate tax, qualification charge and recording charges at the clerk's office. The state probate tax is imposed by Va. Code § 58.1-1712. Grayson County's local-tax status should be asked about directly because a county may impose a local probate tax equal to one-third of the state tax under Va. Code § 58.1-1718.
  5. Receive the certificate of qualification, CC-1625, if you qualify. That certificate is the authority document banks and other institutions normally request from a Virginia personal representative (Va. Code § 64.2-506).
  6. Within 30 days after qualification or admission of the will, send the required notice regarding estate to the people entitled to notice, then record the affidavit of notice within four months in the clerk's office (Va. Code § 64.2-508). The forms are CC-1616, CC-1617 and, when someone waives notice, CC-1618.
  7. Work with the commissioner of accounts for Grayson County. The statewide roster places the commissioner of accounts office in Hillsville. Return the inventory to the commissioner of accounts within four months after the order conferring authority, not to the clerk, and use CC-1670 (Va. Code § 64.2-1300).
  8. Administer assets, claims and distributions. A personal representative's first account is due before the commissioner of accounts within 16 months from qualification and covers the first 12 months (Va. Code § 64.2-1304). Virginia also allows an optional creditor notice process under Va. Code § 64.2-508.1.
  9. Close the estate settlement through the commissioner of accounts, either by an account or, when the statewide requirements fit, a statement in lieu of settlement of account using CC-1681 under Va. Code § 64.2-1314.
