For a determination of descent after an estate was never opened, Minnesota uses a different venue statute. That petition may be filed in the county of the decedent's residence or in a county where the property is located (Minn. Stat. § 525.31).
The jurisdiction process

- Receive letters if appointed. After appointment, the personal representative receives letters testamentary when there is a will, or letters of administration when there is no will. These letters show authority to administer the estate.
- Administer and close the estate. The personal representative gathers assets, gives required notices, addresses creditor claims, accounts for the estate, distributes property, and closes through the Minnesota closing path that matches the case.
