The jurisdiction process

- Complete notice and publication when the chosen procedure requires it. Formal probate requires notice to interested persons, and testacy proceedings require publication under the Minnesota probate rules.
- Watch the hearing notice. Minnesota's statewide policy sets probate hearings as remote by default, but the judicial officer may change the format and the notice tells you how to appear.
- If appointed, obtain letters testamentary or letters of administration, depending on whether there is a will. Those letters are the personal representative's authority to act for the estate.
- Administer the estate, including creditor steps, inventory, accountings, transfers and tax questions. Close the estate using the proper statewide closing forms or a court order, depending on the track.
