The Red Lake County District Court serves probate matters filed in Red Lake County from the courthouse in Red Lake Falls. Venue for the first informal or formal probate proceeding is the county where the decedent was domiciled at death, or, if the decedent was not domiciled in Minnesota, any Minnesota county where the decedent had property at death (Minn. Stat. § 524.3-201).
Red Lake County is in the Ninth Judicial District with Norman, Polk, Marshall, Kittson, Roseau, Mahnomen, Pennington, Aitkin, Itasca, Crow Wing, Hubbard, Beltrami, Lake of the Woods, Clearwater, Cass and Koochiching counties. The district has 24 judges and permanent chambers at Crookston, Thief River Falls, Bemidji, Brainerd, Grand Rapids and International Falls (Minn. Stat. § 2.722, subd. 1). Red Lake Falls is not one of those chambers cities, so judges may travel, but a Red Lake County estate remains filed in Red Lake County.
If the family is using a determination of descent for property from an estate that was never opened, Minnesota uses a different venue rule: the petition may be filed in the county of the decedent's residence or in a county where the property is located (Minn. Stat. § 525.31).
The jurisdiction process
- Choose the opening path. Informal probate starts with an application to the probate registrar for an administrative determination, while formal probate starts with a petition to a judge for a judicial determination (Minn. Gen. R. Prac. 402).
