Before you begin — know the assets and liabilities
Before filing in St. Cloud, identify the assets, liabilities and title paths. Minnesota probate applications require approximate values for probate assets, non-probate assets and indebtedness, and they require a statement that rules out heirs or devisees other than the people listed (Minn. Which court handles jurisdiction
The Stearns County District Court serves the entire county from the Stearns County Courthouse at 725 Courthouse Square in St. Cloud. The court's published service split also lists 815 Courthouse Square for criminal, traffic and fine payments, so a family starting an estate should orient first to 725 Courthouse Square and the Court Administrator's office.
Stearns County is in the Seventh Judicial District with Becker, Benton, Clay, Douglas, Mille Lacs, Morrison, Otter Tail, Todd and Wadena Counties. St. Cloud is one of the four cities where Minnesota law requires permanent chambers for that district, along with Moorhead, Fergus Falls and Little Falls (Minn. Stat. § 2.722, subd. 1). The district is an administrative grouping, not a substitute for venue, and judges serve across the district.
For the first informal or formal testacy or appointment proceeding, venue is the county of the decedent's domicile at death, or, if the decedent was not domiciled in Minnesota, any county where the decedent's property was located at death (Minn. Stat. § 524.3-201(a)). For a determination of descent, Minnesota law also allows filing in the county of the decedent's residence or in a county where the property is located (Minn. Stat. § 525.31).
The jurisdiction process
- Confirm that Stearns County is the right venue. The first proceeding belongs in the county of the decedent's domicile at death, or, for a decedent not domiciled in Minnesota, in any county where the decedent's property was located at death (Minn. Stat. § 524.3-201(a)).
- Choose the route. An informal application goes to the probate registrar and seeks an administrative determination without prior notice and without a hearing. A formal petition goes before a judge with notice to interested persons and seeks a judicial determination (Minn. Gen. R. Prac. 402(a), (b)).
- Prepare the statewide forms. Stearns County publishes no local probate forms, so use the Minnesota PRO forms: PRO802 or PRO702 for an informal opening, or PRO1202 or PRO1102 for a formal opening, with the matching instructions and affidavits.
- Build the asset schedule before signing. Minnesota requires approximate values for probate assets, non-probate assets and indebtedness, and a statement that specifically eliminates heirs or devisees other than those listed (Minn. Gen. R. Prac. 408(a)).
- File with the Court Administrator's office. A self-represented filer may use eFile and eServe or file on paper at 725 Courthouse Square or by mail to the same address. Attorneys, government agencies and guardians ad litem must use eFile and eServe (Minn. Gen. R. Prac. 14.01).
- Deposit the original will on paper. A copy of the will may be filed electronically, but the original will cannot be e-filed and must be deposited with the court (Minn. Gen. R. Prac. 14.01(b)(2), 403(e)).
- Pay the charge due on the first paper. The amount is $310 plus Stearns County's $14 law library fee, current as of August 2026 (Minn. Stat. § 357.021, subd. 2(1); Minn. Stat. §§ 134A.09, 134A.10). The same components apply to informal and formal probate, and a person who cannot afford court costs may ask for a fee waiver or reduction under Minn. Stat. § 563.01, subd. 3.
- Complete notice. Formal testacy proceedings require mailed notice and publication, with proof of publication filed with the Court Administrator's office before the order issues (Minn. Gen. R. Prac. 404(b)). Informal appointment does not require prior notice, but the required post-appointment mailing is documented with the matching affidavit.
- Follow the hearing notice if the case is formal. Minnesota's statewide default for probate hearings is remote, by Zoom or telephone, under Judicial Council Policy 525, effective February 3, 2025. That default is not a promise. A judicial officer may deviate case by case, and the hearing notice controls. Form OTH1002 is used to ask for a different appearance format.
- Obtain letters and certified copies. The court or registrar issues letters testamentary when there is a will and letters of administration when there is not. Certified copies cost $14 each, current as of August 2026 (Minn. Stat. § 357.021, subd. 2(2)). For real estate, a certified copy of unrestricted letters given to a purchaser or distributee requires that 30 days have elapsed since letters were issued to an informally appointed personal representative (Minn. Gen. R. Prac. 410(a)(1), (b)(2)(i)).
- Administer and close the estate. Notice to creditors is published under the direction of the Court Administrator's office in a legal newspaper in the county (Minn. Stat. § 524.3-801(a)). An unsupervised estate commonly closes by sworn statement on PRO914 with the inventory, final account and receipts. A formal settlement uses a petition to settle and distribute, with discharge through the court.
