Before you begin — know the assets and liabilities

Which court handles jurisdiction
Anoka County probate filings go to the Court Administrator's office of the Anoka County District Court at the Anoka County Courthouse, 2100 3rd Ave. in Anoka. One courthouse serves the whole county, including communities such as Blaine, Coon Rapids, Andover, Ramsey, Fridley, Ham Lake, Lino Lakes and Columbia Heights.
Anoka County is in the Tenth Judicial District with Chisago, Isanti, Kanabec, Pine, Sherburne, Washington and Wright counties. The district is an administrative grouping, not a filing location. Court proceedings happen in the county district court where the case is filed, and Minn. Stat. § 2.722, subd. 1 places permanent chambers at Anoka, Stillwater and other locations designated by the chief judge.
Venue for the first informal or formal testacy or appointment proceeding is the county where the decedent was domiciled at death. If the decedent was not domiciled in Minnesota, venue is any county where the decedent's property was located at death (Minn. Stat. § 524.3-201).
The jurisdiction process
- Confirm that Anoka County is the right county. Venue is based on the decedent's domicile at death, or, for a non-Minnesota domiciliary, on where property was located at death (Minn. Stat. § 524.3-201).
- Choose the Minnesota route. Informal probate uses an application to the probate registrar for an administrative determination without prior notice and without a hearing. Formal probate uses a petition to a district court judge for a judicial determination with notice and a hearing (Minn. Gen. R. Prac. 402(a), (b); Minn. Stat. § 524.1-307).
- Assemble the statewide forms. Use PRO802 with PRO801 and PRO803 for an informal case with a will, PRO702 with PRO701 and PRO703 for an informal case without a will, PRO1202 with PRO1201 and PRO1203 for a formal case with a will, or PRO1102 with PRO1101 and PRO1103 for a formal case without a will. - Get the original will to the court. A copy of the will may be e-filed, but the original paper will cannot be filed electronically and must be promptly deposited with the court (Minn. Gen. R. Prac. 14.01(b)(2); Minn. Gen. R. Prac. 403(e)).
- File with the Court Administrator's office of the Anoka County District Court. Attorneys, government agencies and guardians ad litem use eFile and eServe. Formal proceedings require notice to interested persons before the hearing, and a formal testacy proceeding requires proof of publication before the order will issue (Minn. Gen. R. Prac. 404(b)).
- Use the hearing notice as the appearance instruction. Minnesota's statewide default for probate hearings is remote, on Zoom or by telephone, under Judicial Council Policy 525, effective February 3, 2025. A judicial officer may set a different appearance type, and the hearing notice controls. Use OTH1002 to ask for a different appearance type.
- Receive letters and order certified copies. The authority document is letters testamentary when there is a will or letters of administration when there is not. Certified copies cost $14 each, current as of August 2026 (Minn. Stat. § 357.021, subd. 2(2)). In an informal appointment, 30 days must pass after letters are issued before a certified copy of unrestricted letters is given to a purchaser or distributee of real property (Minn. Gen. R. Prac. 410(a)(1), (b)(2)(i)).
- Administer and close the estate. Use PRO912 for the inventory and PRO913 for the final account and proposal for distribution. An unsupervised estate closes with PRO914, PRO915 and PRO916. A formal settlement uses PRO1302, with discharge requested on PRO1304.
