Before you begin — know the assets and liabilities

Before you file in Cartersville, list what the person owned, what was jointly held, what had a beneficiary, what debts exist and whether there is an original will. That asset and liability picture drives whether the estate settlement needs letters testamentary, letters of administration, year's support under O.C.G.A. § 53-3, an order that no administration is necessary under O.C.G.A. § 53-2-40, or no court filing for a particular asset.

Sunset helps families build that picture before they choose a form. Its asset discovery checks more than 2,300 institutions, then helps organize accounts, real estate, debts and documents so you can speak with the Bartow County Probate Court or a Georgia probate attorney from a complete estate settlement file.

Which court handles jurisdiction

The Bartow County Probate Court in Cartersville serves the entire county from one filing location at 135 W. Cherokee Avenue, Suite 243A. It serves people who lived in Cartersville, Adairsville, Cassville, Emerson, Euharlee, Kingston, Taylorsville, White and the unincorporated areas of Bartow County.

Georgia has one probate court in each county, and a Bartow County estate is filed with the Bartow County Probate Court, not with another county office. Administration may be granted for a person who was a Bartow County resident at death, or for a nonresident of Georgia who owned property in Bartow County or had a cause of action here (O.C.G.A. § 15-9-31). A petition for an order that no administration is necessary is filed where the decedent was domiciled, or where Georgia real property is located if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).

Bartow County is an Article 6 probate court under O.C.G.A. § 15-9-120. In a civil probate case, a party may demand a jury trial in writing under O.C.G.A. § 15-9-121, and an appeal goes directly to the Court of Appeals of Georgia or the Supreme Court of Georgia under O.C.G.A. § 15-9-123.

The jurisdiction process

  1. Find the will and the asset list. Whoever holds the will must file it with the Bartow County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). The original will is paper and must go to the court.
  2. Choose the statewide petition. With a will, Georgia probate is in common form or solemn form (O.C.G.A. § 53-5). Common form does not become conclusive until four years from the order admitting the will (O.C.G.A. § 53-5-19). Without a will, the usual petition is for letters of administration, and the heirs' agreement affects who can serve (O.C.G.A. § 53-6-20).
  3. File with the Bartow County Probate Court. File at 135 W. Cherokee Avenue, Suite 243A, Cartersville, GA 30120. Bartow County uses the statewide GPCSF forms and does not publish a local cover sheet or estate packet.
  4. Pay the filing fee when you file. The court says filing fees are due upon filing. The statutory base fee for a decedent's-estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60, plus statutory add-ons, including the indigent defense fee under O.C.G.A. § 15-21A-6, and separate service and publication costs. Confirm the current total with the court.
  5. Get scheduled for the judge appearance. After the pleadings are filed and the fee is paid, Bartow County schedules a time for the petitioner to appear before the judge. The court states that all matters are handled by appointment only.
  6. Complete notice, service or publication. The court issues the citation. The petitioner handles service, acknowledgments or publication as required. Solemn form probate requires notice to heirs under O.C.G.A. § 53-5-22, and published citations in Bartow County run through The Daily Tribune News.
  7. Take the oath and address bond. The oath must be administered by a probate judge or clerk, not by a notary (O.C.G.A. § 53-6-24). An out-of-state petitioner can use GPCSF 53. An administrator of an intestate estate gives bond unless it is waived by unanimous heir consent (O.C.G.A. § 53-6-50).
  8. Receive letters. Once the court admits the will or appoints the administrator and the petitioner qualifies, the court issues letters testamentary or letters of administration. Certified copies of letters cost $10.00, effective January 1, 2025, under O.C.G.A. § 15-9-60.
  9. Publish creditor notice. The personal representative publishes notice to creditors within 60 days after qualification, once a week for four weeks in the county's official newspaper. Creditors who do not notify the personal representative within three months of the last publication lose equal participation under O.C.G.A. § 53-7-41.
  10. Administer and close the estate. File the inventory with the Probate Court and mail copies within six months unless waived (O.C.G.A. §§ 53-7-30 and 53-7-32). Pay claims, make distributions, file required returns or fiduciary compliance reports, then seek discharge on GPCSF 33.

Forms and documents

Probate forms in Bartow County

Bartow County uses the statewide Georgia Probate Court Standard Forms, the numbered GPCSF series adopted for use in Georgia probate courts. A document prepared on a standard form is acceptable in any Georgia probate court, and a court may decline to process a substitute document that does not conform to the standard form under Uniform Probate Court Rule 5.9.

The Bartow County Probate Court does not publish county-specific probate forms, a local cover sheet, a local checklist or a local estate packet. Its estates page links to the statewide forms and to the court's booklet, What to do when a loved one dies. The court also states that staff cannot tell you which petition to file or how to fill out the forms, but staff can answer basic questions about standard forms and filing deadlines.

Scenarios

ScenarioLikely Bartow County pathWhere Sunset helps
Surviving spouse with a co-owned homeProperty held with survivorship or a beneficiary usually passes outside the estate. If the home or accounts were in the decedent's sole name, the spouse files in Cartersville, pays the fee at filing, and is scheduled to appear before the judge. Year's support under O.C.G.A. § 53-3 can set aside property for a surviving spouse or minor children and must be filed within 24 months of death under O.C.G.A. § 53-3-5.Sunset separates probate and nonprobate assets, gathers account information and helps the spouse compare ordinary administration with a year's support conversation with counsel.
Out-of-state adult child with a small estatePlan around Bartow County's appointment practice: file the pleadings, pay the fee, then get a time to appear before the judge. The oath cannot be notarized, so an out-of-state petitioner can use GPCSF 53 to swear before a court where they live. If the only asset is a bank deposit, ask the financial institution whether O.C.G.A. § 7-1-239 allows payment without a probate filing.Sunset helps identify whether there are accounts beyond the first bank, organizes death certificates and statements, and prepares questions for the Probate Court before the family travels.
Parent settling a predeceased child's estate, home must be soldA sale usually requires authority from the Bartow County Probate Court. The personal representative may need powers under O.C.G.A. § 53-7-1(b) and GPCSF 32, or leave to sell on GPCSF 13. If there is no will, all heirs agree, and debts are handled, an order that no administration is necessary under O.C.G.A. § 53-2-40 may vest title in the heirs, with any Bartow County land order recorded in the deed records through the Clerk of Superior Court.Sunset builds the asset list, flags mortgages and title issues, and connects the family to a Bartow County probate attorney when a house sale, consents or a contest is involved.

When to hire an attorney

You can file a Bartow County probate petition without a lawyer, but the court will not choose the petition for you or tell you how to complete the forms. Counsel makes sense when a house must be sold, heirs do not all agree, bond or powers need to be waived, an objection or caveat is possible, or the Article 6 court's jury and appellate rules could matter. Sunset connects families with a vetted Georgia probate attorney who handles Bartow County matters.
