Before you begin — know the assets and liabilities
Before you file in Nashville, list the decedent's assets, debts, heirs, beneficiaries, real estate and account ownership. Berrien County uses the same statewide Georgia probate forms as other counties, but the right estate settlement path depends on whether there is a will, whether property passes outside probate, whether heirs agree, and whether land must be sold.
Sunset can help with early asset discovery by searching across more than 2,300 financial institutions. That information can help you decide whether the estate needs letters testamentary, letters of administration, year's support, no administration is necessary, or another Georgia estate settlement step before you call or visit the Berrien County Probate Court.
Which court handles jurisdiction
The Berrien County Probate Court in Nashville is the filing office for probate matters in Berrien County. It serves Nashville, the county seat, and the unincorporated communities and farmland across Berrien County. Georgia has one probate court in each county, so a Berrien County estate is filed with the Berrien County Probate Court and not with a regional probate office.
Administration may be granted only on the estate of someone who lived in Berrien County at death, or on the estate of a nonresident of Georgia who owned property in Berrien County or had a cause of action here (O.C.G.A. § 15-9-31). A petition for an order that no administration is necessary is filed in the county of the decedent's domicile, or where the real property is located if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).
A party seeking review of a Berrien County Probate Court decision files a petition for review in the superior court within 30 days of the judgment (O.C.G.A. § 5-3-7(b)). The superior court proceeding is de novo, with the right to a jury preserved (O.C.G.A. § 5-3-5(d)).
The jurisdiction process
- Find the original will, if one exists. Whoever has the will must file it with the Berrien County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). File at 201 North Davis Street, Room 175, Nashville, GA 31639, or mail the paper filing to that address.
- Choose the Georgia petition that matches the estate. With a will, probate may be in common form or solemn form (O.C.G.A. § 53-5-15). Common form is not conclusive for four years from the order admitting the will (O.C.G.A. § 53-5-19). With no will, the usual petition is for letters of administration, and heirs may select an administrator as provided by O.C.G.A. § 53-6-20. If the heirs agree and the statutory conditions fit, a petition for an order declaring no administration is necessary is filed under O.C.G.A. § 53-2-40.
- Use the statewide GPCSF form set. Berrien County publishes no probate forms of its own, so use the Georgia Probate Court Standard Forms for the petition, oath, bond, service documents and any later request for discharge.
- Pay the filing costs at filing. The base fee for a decedent's-estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60. The $15.00 indigent defense fee under O.C.G.A. § 15-21A-6 applies to each named decedent's-estate petition, and service of process and publication are separate. Confirm the current total with the Berrien County Probate Court before filing.
- Handle citation, service and publication. The court issues the citation, and you arrange service, acknowledgments or publication as the petition requires. Published citations in Berrien County run in The Berrien Press.
- Ask about any hearing before you plan travel. Berrien County Probate Court publishes no hearing calendar or remote appearance policy. Call (229) 686-5213 to ask whether a hearing is needed and whether any part can be handled without appearing in person.
- Take the oath and address bond. The oath must be administered by a probate judge or clerk, not by a notary, and an out-of-state petitioner can use GPCSF 53. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50).
- Receive authority from the court. After the petition, notice, oath and any bond are complete, the court issues letters testamentary or letters of administration. Those letters are the personal representative's proof of authority to gather assets, work with banks, and continue estate settlement.
- Publish the creditor notice and administer the estate. The personal representative must publish notice to creditors within 60 days of qualification, once a week for four weeks, in The Berrien Press. Creditors who do not notify the personal representative within three months of the last publication lose equal participation rights under O.C.G.A. § 53-7-41.
- File required reports and close. Unless waived, the personal representative files an inventory with the court and mails a copy to heirs or beneficiaries within six months of qualification (O.C.G.A. § 53-7-30, § 53-7-32). After claims are addressed, property is distributed and required fiduciary compliance reports are handled, use GPCSF 33 to petition for discharge.

If property stood in the decedent's sole name, file on paper with the Berrien County Probate Court. Publication runs in The Berrien Press. | Sunset helps identify which assets are probate assets, which pass outside court, and what information belongs in the filing packet. |

| Parent settling predeceased child's estate, home must be sold | A sale of a Berrien County house usually requires letters and either expanded powers under O.C.G.A. § 53-7-1(b) with GPCSF 32, or a petition for leave to sell using GPCSF 13. If there is no will, all heirs agree, and debts are resolved, an order that no administration is necessary under O.C.G.A. § 53-2-40 may vest title in the heirs, with the order affecting Berrien County land recorded in the deed records. | Sunset helps sort heirs, debts, property information and attorney needs before the family chooses between letters, a sale petition, or a no-administration order. |
