Before you begin — know the assets and liabilities
Before you choose a Gordon County probate filing, list what the person owned, how each asset is titled, what debts exist and whether a beneficiary or survivorship designation already controls the asset. That first inventory determines whether the family needs letters testamentary, letters of administration, year's support, an order that no administration is necessary or no court filing at all.
Sunset's estate settlement process includes asset discovery across more than 2,300 financial institutions, which can help a family decide whether a paper filing in Calhoun is needed and what information must go into the Georgia probate forms.
Which court handles jurisdiction
The Gordon County Probate Court is the only filing office for a Gordon County estate. File at the Gordon County Courthouse in Calhoun for a decedent who lived in Gordon County at death, or for a nonresident of Georgia who owned property in Gordon County or had a cause of action here (O.C.G.A. § 15-9-31). An order that no administration is necessary is filed in the decedent's Georgia county of domicile, or where the real property is located if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).
The court serves Calhoun, Fairmount, Plainville, Ranger, Resaca, Sugar Valley and the unincorporated communities across Gordon County. Georgia has one probate court in each county, so Gordon County estate filings do not go to another county or to a separate district office.
For review of a Gordon County Probate Court decision, a party files a petition for review in the superior court within 30 days of the judgment (O.C.G.A. § 5-3-7(b)). The superior court proceeding is de novo, with the jury right preserved (O.C.G.A. § 5-3-5(d)).
The jurisdiction process
- File the original will, if there is one, with the Gordon County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). Gordon County does not offer probate e-filing, so the original will and any codicil go on paper to the courthouse or by mail.
- Choose the Georgia petition that fits the estate. With a will, use common form or solemn form under O.C.G.A. § 53-5-15. Common form is not conclusive for four years from the order admitting the will under O.C.G.A. § 53-5-19. With no will, petition for letters of administration under O.C.G.A. § 53-6-20.
- Prepare the statewide GPCSF forms and file them on paper at the Gordon County Courthouse, 3rd Floor, 100 S. Wall Street, Calhoun, GA 30701, or by mail to P.O. Box 669, Calhoun, GA 30703.
- Pay the filing costs when you file. The statutory base fee for a decedent's-estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60, with statutory add-ons and separate service and publication costs. Call (706) 629-7314 to confirm the current amount due.
- Complete citation, service, acknowledgment or publication as directed by the court. Solemn form requires personal service on heirs at least 30 days before probate unless waived (O.C.G.A. § 53-5-22). Published citations in Gordon County run in the Calhoun Times.
- Take the oath before the Probate Judge or a court clerk. The oath cannot be taken before a notary public. If you are out of state, ask about GPCSF 53, Commission to Administer Oath.
- Address bond if required. An administrator of an intestate estate must give bond unless all heirs consent to waive it (O.C.G.A. § 53-6-50).
- Receive letters testamentary or letters of administration after the court approves the petition and the personal representative qualifies.
- Publish the notice to creditors within 60 days after qualification, once a week for four weeks, in the Calhoun Times. Creditors who do not notify the personal representative within three months after the last publication lose equal participation with creditors paid earlier (O.C.G.A. § 53-7-41).
- Prepare the inventory and mail copies to heirs or beneficiaries within six months after qualification unless the duty is waived or the court extends the time (O.C.G.A. § 53-7-30, O.C.G.A. § 53-7-32).
- Collect assets, pay valid claims, distribute property, file any required fiduciary compliance report, and close the estate with a petition for discharge on GPCSF 33.

Scenarios
| Person | Likely Gordon County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with a co-owned home | Property held with survivorship or a beneficiary designation may pass outside the estate. If the house or accounts were in the decedent's sole name, file on paper with the Gordon County Probate Court. Year's support can set aside property for a spouse or minor children, including a home, under O.C.G.A. § 53-3-1 and must be filed within 24 months of death under O.C.G.A. § 53-3-5. | Sunset helps identify title, account ownership and beneficiary information before the family chooses an estate settlement path. |
| Out-of-state adult child with a small estate | Gordon County has no probate e-filing, so paper filings and the original will go to Calhoun by mail or in person. The oath must be taken before a probate judge or clerk, not a notary public, so an out-of-state petitioner can ask about GPCSF 53. If the only asset is a bank deposit, a financial institution may be able to pay a $15,000.00 or less deposit, as amended in 2019, without a court filing under O.C.G.A. § 7-1-239. | Sunset helps determine whether a court filing is needed and organizes the forms and asset details for a mailed or in-person filing. |
| Parent settling a predeceased child's estate, home must be sold | Selling a house usually requires authority from the Gordon County Probate Court. A personal representative may seek expanded powers under O.C.G.A. § 53-7-1(b) on GPCSF 32 or seek leave to sell on GPCSF 13. If there is no will, all heirs agree and debts are resolved, an order that no administration is necessary under O.C.G.A. § 53-2-40 may vest title in the heirs, with a certified copy recorded for Gordon County land. | Sunset helps map heirs, identify debts and assets, and connect the family with a Gordon County probate attorney when a sale or title issue needs legal advice. |
