Before you begin — know the assets and liabilities

Before you file in Summerville, identify the assets, debts, heirs, beneficiary designations, and any real estate. The right Georgia petition depends on what the decedent owned, whether there is a will, whether the heirs agree, and whether a personal representative needs authority to sell or collect property.

Sunset's estate settlement tools include asset discovery across more than 2,300 financial institutions, which can help you decide whether Chattooga County probate is needed before you pay a filing fee or mail original documents to the court.

Which court handles jurisdiction

The Chattooga County Probate Court at 10035 Commerce Street in Summerville is the filing office for probate and estate matters in Chattooga County. Georgia has one probate court in each county, so Chattooga County filings go to this Probate Court, not to a regional probate office or district.

The court serves Summerville, the county seat, and the unincorporated communities across Chattooga County in northwest Georgia. Administration may be granted only for the estate of a person who lived in Chattooga County at death, or for a nonresident of Georgia who owned property in Chattooga County or had a cause of action here (O.C.G.A. § 15-9-31). A petition for an order declaring no administration is necessary is filed in the decedent's Georgia county of domicile, or where the real property is located if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).

A party seeking review of a Chattooga County Probate Court decision files a petition for review in the superior court within 30 days of the judgment (O.C.G.A. § 5-3-7(b)). The review proceeding is de novo with the jury right preserved (O.C.G.A. § 5-3-5(d)).

The jurisdiction process

  1. Identify the assets and choose the Georgia petition. If there is a will, file the original will with reasonable promptness (O.C.G.A. § 53-5-5) and choose common form or solemn form probate under O.C.G.A. § 53-5. Common form is not conclusive for four years from the order admitting the will (O.C.G.A. § 53-5-19). If there is no will, the usual petition is for letters of administration under O.C.G.A. § 53-6-20.
  2. Prepare the statewide GPCSF forms. Chattooga County does not post local decedent's-estate forms, so use the statewide GPCSF forms under Uniform Probate Court Rule 5.9. Include the death certificate, heirs, addresses, proposed personal representative, and the original will if there is one.
  3. File on paper in Summerville. File at the Chattooga County Probate Court, 10035 Commerce Street, Summerville, GA 30747, or by mail. There is no probate e-filing option posted for Chattooga County, and the original will and any codicil must be delivered on paper.
  4. Pay the filing costs at filing. The statutory base fee for a decedent's-estate petition is $175.00, effective January 1, 2025 (O.C.G.A. § 15-9-60), plus statutory add-ons, including the $15.00 indigent defense fee for covered decedent's-estate petitions (O.C.G.A. § 15-21A-6), and separate service and publication costs. Call 706-857-0709 to confirm the current amount before filing.
  5. Handle citation, service, and any publication. The court issues the citation. When publication is required in Chattooga County, it runs in The Summerville News. The petitioner must provide required service copies and follow the court's instructions for acknowledgments, service, or publication.
  6. Attend any hearing the court sets. Chattooga County does not post a probate hearing calendar or remote appearance procedure. If you cannot appear in Summerville, call the court before the hearing date and ask what the judge will allow.
  7. Take the oath and address bond. Before letters issue, the personal representative must take the oath before a probate judge or clerk, not a notary (O.C.G.A. § 53-6-24). An out-of-state petitioner can use GPCSF 53. Bond is required for an intestate administrator unless waived by unanimous heir consent (O.C.G.A. § 53-6-50).
  8. Receive letters and administer the estate. Once qualified, the personal representative receives letters testamentary or letters of administration. Certified copies of letters cost $10.00 under the fee schedule effective January 1, 2025 (O.C.G.A. § 15-9-60).
  9. Publish the creditor notice. The personal representative must publish notice to creditors within 60 days of qualification, once a week for four weeks, in the official newspaper of the county. In Chattooga County, that is The Summerville News. Creditors have three months from the last publication to give notice of claims as provided in O.C.G.A. § 53-7-41.
  10. Inventory, distribute, and close. Unless relieved, the personal representative files an inventory with the court and mails it to heirs or beneficiaries within six months (O.C.G.A. § 53-7-30 and § 53-7-32). After paying valid claims and distributing property, file any required fiduciary compliance report and petition for discharge on GPCSF 33.
