Before you begin — know the assets and liabilities
Before you choose a Georgia probate form, make a working list of assets, debts, account ownership and beneficiary designations. In Stephens County, that is especially important because you may need to call the Probate Court before filing to ask about copies, payment, publication and whether the court wants any local cover materials with the statewide GPCSF form.
Sunset's 2,300-institution asset discovery can help identify bank, brokerage and other financial accounts before you commit to an estate settlement path. A clearer asset picture helps you decide whether the family needs letters testamentary, letters of administration, year's support, an order that no administration is necessary, or attorney help.
Which court handles jurisdiction
The Stephens County Probate Court at 70 North Alexander Street, Suite 108, Toccoa, GA 30577 serves Stephens County, including Toccoa and the rest of the county. Georgia has one probate court in each county, so Stephens County estate filings go to the Stephens County Probate Court, not to a regional probate office.
Administration may be granted in Stephens County when the decedent lived in Stephens County at death, or when a nonresident of Georgia owned property in Stephens County or had a cause of action here (O.C.G.A. § 15-9-31). A petition for an order that no administration is necessary is filed in the decedent's Georgia county of domicile, or in the county where Georgia real property is located if the decedent was not domiciled in Georgia (O.C.G.A. § 53-2-40).
Stephens County is not listed as an Article 6 probate court under O.C.G.A. § 15-9-120. A party seeking review of a Stephens County Probate Court decision files a petition for review in the superior court within 30 days of the judgment under O.C.G.A. § 5-3-7(b). The superior court proceeding is de novo, with the jury right preserved under O.C.G.A. § 5-3-5(d).
The jurisdiction process
- Locate the will, if there is one, and file the original with the Stephens County Probate Court with reasonable promptness (O.C.G.A. § 53-5-5). File on paper at 70 North Alexander Street, Suite 108, Toccoa, GA 30577, unless the court gives you different instructions.
- Choose the correct statewide GPCSF petition. With a will, Georgia probate may be in common form or solemn form (O.C.G.A. § 53-5-15). Common form is not conclusive for four years from the order admitting the will (O.C.G.A. § 53-5-19). With no will, the usual petition is for letters of administration, and administrator selection follows O.C.G.A. § 53-6-20.
- Pay the filing costs when you file. The statutory base for a decedent's-estate petition is $175.00, effective January 1, 2025, under O.C.G.A. § 15-9-60, plus statutory add-ons and any service or publication costs. Call the court for the current total.
- Handle citation, notice and service. The court issues the citation. In solemn form matters, heirs receive notice under O.C.G.A. § 53-5-22. Ask the Stephens County Probate Court which newspaper handles required publication for Stephens County legal notices and what the publication charge is.
- Take the oath before the probate judge or a clerk, not before a notary. An out-of-state petitioner should ask about GPCSF 53, Commission to Administer Oath (O.C.G.A. § 53-6-24).
- Address bond before letters issue. An administrator of an intestate estate generally gives bond unless the heirs unanimously consent to waive it (O.C.G.A. § 53-6-50).
- Receive letters testamentary or letters of administration after the court approves the petition and the personal representative qualifies. Those letters are the document banks, buyers and other institutions usually ask to see during estate settlement.
- Publish the creditor notice within 60 days after qualification, once a week for four weeks, in the official newspaper of the county. Creditors who do not notify the personal representative within three months after the last publication lose equal participation rights as provided in O.C.G.A. § 53-7-41.
- Prepare the inventory unless it is waived. The personal representative files the inventory with the court and mails it to heirs or beneficiaries within six months after qualification unless relieved or waived under O.C.G.A. §§ 53-7-30 and 53-7-32.
- Pay valid claims, manage or sell property only with proper authority, distribute the estate, file required fiduciary compliance materials, and close with GPCSF 33 when the estate is ready for discharge.
Forms and documents
Probate forms in Stephens County
Georgia uses one statewide set of numbered probate forms, the GPCSF series. A document prepared on a Georgia Probate Court Standard Form is acceptable in any Georgia probate court, and a court may decline to process a substitute that does not conform to the standard form under Uniform Probate Court Rule 5.9.
For Stephens County estate settlement, start with the statewide forms for the path you need, such as GPCSF 3 for letters of administration, GPCSF 4 for probate of a will in common form, GPCSF 5 for probate of a will in solemn form, GPCSF 7 for solemn form with letters of administration with will annexed, GPCSF 9 for an order that no administration is necessary under O.C.G.A. § 53-2-40, GPCSF 10 for year's support under O.C.G.A. § 53-3, GPCSF 13 for leave to sell property, GPCSF 32 for powers or waivers, GPCSF 33 for discharge, and GPCSF 53 if an out-of-state petitioner needs a commission to take the oath.
No Stephens County-specific probate packet is available for this page to direct you to. Before mailing a petition, call (706) 886-2828 and ask whether the court wants extra copies, envelopes, a cover sheet or a particular payment method.

Scenarios
| Scenario | Stephens County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | Check the deed and account ownership first. Property with survivorship or beneficiary designations may pass outside the estate. If the home or accounts were solely titled, file the appropriate statewide form with the Stephens County Probate Court. Year's support under O.C.G.A. §§ 53-3-1 and 53-3-5 can set aside property, including a family home, and must be filed within 24 months of death. | Sunset helps identify accounts, organize title and beneficiary details, and prepare the family for a cleaner estate settlement conversation with the court or attorney. |
| Out-of-state adult child with a small estate | Plan for paper filing by mail or in person because no Stephens County estate e-filing path is available for this page to direct you to. The original will is paper. The oath cannot be notarized, so ask about GPCSF 53 if you need to take the oath before a court where you live. A limited bank deposit release may be available under O.C.G.A. § 7-1-239 without opening a court estate when that statute fits the account and family facts. | Sunset helps sort assets from nonprobate transfers, prepare the Georgia form packet, and identify when travel can be avoided. |
| Parent settling predeceased child's estate, home must be sold | Selling a house usually requires authority from the Stephens County Probate Court. The personal representative may need expanded powers under O.C.G.A. § 53-7-1(b) and GPCSF 32, or a petition for leave to sell on GPCSF 13. If there is no will, all heirs agree, and debts are resolved, an order that no administration is necessary under O.C.G.A. § 53-2-40 can vest title in the heirs; an order affecting Stephens County land is then recorded with the Stephens County Clerk of Superior Court. | Sunset helps assemble asset and debt information, clarify heirs, and connect the family with a Georgia probate attorney when real estate authority is the key issue. |
