The Probate Court of Harris County is the filing office for estates in Harris County. One courthouse location serves the county: 102 North College Street, Room 227, Hamilton, GA 31811. The court serves Hamilton and the unincorporated communities across Harris County.

Georgia has one probate court in each county, and Harris County estate filings go to the Probate Court itself, not to the Clerk of Superior Court. Administration may be granted only for someone who lived in Harris County at death, or for a nonresident of Georgia who owned property in Harris County or had a cause of action against someone here (O.C.G.A. § 15-9-31). If there is a will, the original will and any codicil must be delivered on paper to the Probate Court under Uniform Probate Court Rule 5.3.12(B).

  6. Complete notice. The court issues the citation, and the petitioner must arrange service, acknowledgments or publication as the Georgia form and court require. In Harris County, publication that must run in the county legal organ runs in The Harris County Journal.
  7. Ask the court how any hearing will be handled. Harris County does not state a remote appearance policy, so call (706) 628-5038 if you need to avoid traveling to Hamilton.
  8. Take the oath before the proper court officer. The oath for a personal representative cannot be notarized; it must be administered by a probate judge or clerk, and an out-of-state petitioner can ask about GPCSF 53, Commission to Administer Oath (O.C.G.A. § 53-6-24).
  9. Address bond and authority. Bond may be required unless waived or otherwise relieved under Georgia law (O.C.G.A. § 53-6-50). Once the court approves the petition and the personal representative qualifies, the court issues letters testamentary or letters of administration.
  10. Administer and close the estate. Publish the creditor notice within 60 days of qualification, once a week for four weeks, in The Harris County Journal; creditors have three months from the last publication under O.C.G.A. § 53-7-41. File and mail any required inventory within six months unless waived or extended under O.C.G.A. § 53-7-30 and O.C.G.A. § 53-7-32, pay valid claims, distribute property, and use GPCSF 33 when you are ready to seek discharge.
