Before you begin — know the assets and liabilities

Before filing anything with the Yolo County clerk, know exactly what is in the estate. The right path — small-estate affidavit, Petition to Determine Succession to Real Property, Spousal Property Petition, or full probate — depends entirely on the value and type of the assets, and a petition filed on the wrong path draws a Probate Note flagging the deficiency, which means a continuance and weeks of lost time.

Identify every bank account, retirement plan, brokerage holding, life insurance policy, business interest, and parcel of real property, and every debt, before choosing the path. Which court handles jurisdiction

The Superior Court of California, County of Yolo hears every probate matter in the county — decedents' estates, succession and spousal petitions, conservatorships, guardianships, and trust matters — from the courthouse at 1000 Main Street in Woodland. Families throughout the county, from Davis and West Sacramento to Winters, Esparto, and rural Yolo, file in Woodland; there is no separate probate courthouse in the other cities.

Probate is filed in Yolo County when the decedent was domiciled in the county at death (Cal. Prob. Code § 7051), or owned Yolo County real property as a non-resident (ancillary administration). Decedents' estates are calendared in Department Eleven at 9:00 a.m.; some trust and Heggstad matters are set in Department Fourteen.

The jurisdiction process

  1. Prepare the statewide Judicial Council DE-series forms for your path. Yolo County requires no local probate forms or cover sheets.
  2. File the petition. Attorneys and represented parties must e-file through a One Legal or other approved Tyler-network EFSP (mandatory since August 17, 2020); self-represented filers may e-file or file on paper at the Civil Division, 1000 Main Street, Woodland (Mon–Fri 8:00 AM – 4:00 PM).
  3. Lodge paper-only items in person or by mail: original wills and codicils cannot be e-filed and must be delivered to the court.
  4. Pay the $435 filing fee (statewide fee; no Yolo County surcharge). Fee waivers are available on Judicial Council forms FW-001/FW-003.
  5. Complete notice: publish in a newspaper of general circulation and mail DE-121 notice to heirs and beneficiaries at least 15 days before the hearing (Cal. Prob. Code §§ 8120–8124).
  6. Check the Probate Notes for your case on the court's Probate Note Calendar before the hearing. In Yolo, the notes are a recommendation, not an automatic order; clear any flagged deficiency before the hearing or the matter is continued. To continue a matter, contact the Civil Division at (530) 406-6704 at least 2 court days before the hearing.
  7. Attend the hearing in Department Eleven at 9:00 a.m., in person or by Zoom. If a Probate Note recommends granting your petition and no appearance is required, you need not appear; if you are scheduled to appear and no note has issued, appear as scheduled. The judge admits the will, appoints the personal representative, and issues Letters (DE-150).
  8. Administer and close the estate under the statewide process: creditor notice, the 4-month claim period, Inventory and Appraisal (DE-160), and the petition for final distribution.

Forms and documents

Probate forms in Yolo County

Yolo County has no local probate forms. Every filing uses the statewide Judicial Council DE-series (DE-111 Petition for Probate, DE-121 Notice of Petition to Administer Estate, DE-140 Order for Probate, DE-147 Duties and Liabilities, DE-150 Letters, DE-160 Inventory and Appraisal, and the rest). The county's local rules (effective January 1, 2023) add procedural requirements — chiefly mandatory e-filing for represented parties — but no county-specific probate form.

The practical Yolo-specific paperwork is procedural: represented parties e-file through an approved service provider, and original wills and codicils are lodged with the court on paper because they cannot be e-filed.

Probate Notes are recommendations, not orders. Yolo treats its Probate Notes differently from its civil tentative rulings. A civil tentative ruling becomes the order unless a party requests a hearing by 4:00 p.m. the court day before. A Probate Note is only a recommendation as to the outcome of the petition and does not automatically become the court's order — so you should read the note, clear any deficiency it flags, and be prepared to appear.

Appear-or-not depends on the note. If a Probate Note recommends granting your petition and states that no appearance is necessary, you can skip the hearing. If you are scheduled to appear and no note has issued in your case, you should appear as scheduled in Department Eleven at 9:00 a.m.

Mandatory e-filing for represented parties. Since August 17, 2020, attorneys and represented parties must e-file civil, probate, and family-law documents through an approved Tyler-network EFSP such as One Legal (Local Rule 7). Self-represented filers are exempt and may file on paper at the Woodland courthouse, though they may e-file voluntarily. Ex parte applications and documents requiring personal service are excluded from the e-filing mandate.
