Which court handles jurisdiction

The Superior Court of California, County of Siskiyou hears probate at its courthouse in Yreka, the county seat, for the entire county — including Mount Shasta, Weed, Dunsmuir, Montague, Fort Jones, Etna, Happy Camp, Tulelake, McCloud, and Dorris. The court maintains a small branch in Dorris for limited north-county matters, but decedents' estates, succession petitions, and spousal property petitions are handled at the Yreka courthouse. Probate is filed here when the decedent was domiciled in Siskiyou County at death (Cal. Prob. Code § 7051), or owned Siskiyou County real property as a non-resident (ancillary administration).

There is no separate probate department building. Probate matters are set on the court's regular probate calendar; because the day and hour reserved for that calendar can change, the local rules direct filers to consult the clerk before requesting a specific hearing date (Local Rule 9.02).

The jurisdiction process

  1. Prepare the statewide Judicial Council DE-series forms for your path, plus the court's Case Party Information cover sheet, which must accompany every initial probate filing (Local Rule 2.21). If a probate document is not on a Judicial Council form, its caption must cite the statute under which it is filed (Local Rule 9.01).
  2. Select the initial hearing date allowing enough time for statutory notice, and confirm the date with the clerk before requesting the setting (Local Rule 9.02).
  3. File the petition: on paper in person at 411 Fourth Street, Yreka (8:00 AM – 12:00 PM, 1:00 PM – 4:00 PM), by mail to the same address, or electronically through an authorized Electronic Filing Service Provider. The court does not accept filings by email or fax.
  4. Lodge paper-only items in person or by mail: original wills and codicils, bonds and undertakings, and hearing exhibits cannot be e-filed (Local Rule 2.23).
  5. Pay the $435 filing fee (statewide fee; no Siskiyou County surcharge). Fee waivers are available on Judicial Council forms FW-001/FW-003.
  6. Complete notice: publish in a newspaper of general circulation and mail DE-121 notice to heirs and beneficiaries. Statutory notice for a probate hearing cannot be shortened to fewer than 10 days (Local Rule 9.05).
  7. File every supporting document — affidavit of publication, proof of a subscribing witness (DE-131 where the will is not self-proving), and the proposed order — with the clerk at least five court days before the hearing, or the matter may be continued or dropped (Local Rules 9.03 and 9.06).
  8. Appear at the hearing in person or remotely; to appear remotely, give notice of your intent (Judicial Council form RA-010) and follow the court's remote-appearance instructions. The judge admits the will, appoints the personal representative, and issues Letters (DE-150).
  9. Administer and close the estate under the statewide process: creditor notice, the 4-month claim period, Inventory and Appraisal (DE-160), and the petition for final distribution.

Timeline

Self-proving wills skip a step. If the will's attestation clause is signed under penalty of perjury, Siskiyou treats it as self-proving and admits it without separate proof; otherwise a subscribing witness must file Judicial Council form DE-131 (Local Rule 9.07).
