Before you begin — know the assets and liabilities

Before filing anything in Room 107, know exactly what is in the estate. Santa Clara probate cases are assigned to an all-purpose judge at filing, and every petition is screened by a probate examiner before the hearing — a petition filed before the family understands the assets draws examiner notes on the Advance Case Status Report, and unresolved notes mean continuances. A complete, correct petition earns the pre-approved notation instead, and pre-approved matters are granted without anyone appearing in court.

Identify every bank account, brokerage, retirement plan, life insurance policy, stock plan and equity compensation account — common in Silicon Valley estates — and every parcel of real property and debt before choosing the path: small-estate affidavit, succession petition, spousal property petition, or full probate. Which court handles jurisdiction

The Probate Division of the Santa Clara County Superior Court hears every probate matter in the county — decedents' estates, spousal property and succession petitions, trusts, conservatorships, and guardianships — at the Downtown Superior Court, 191 North First Street, San Jose. Families everywhere in the county, from Palo Alto and Mountain View to Gilroy and Morgan Hill, file at this one courthouse; the county's other court facilities handle no probate. Venue is proper in Santa Clara County when the decedent was domiciled here at death (Cal. Prob. Code § 7051), or owned Santa Clara County real property as a non-resident (ancillary administration).

New probate cases are randomly assigned to a judicial officer for all purposes — the All-Purpose Judge (APJ) — under Local Probate Rule 1A. Decedents' estates are heard in Department 2 (Mondays and Thursdays) and Department 13 (Wednesdays and Fridays), and every document filed in the case must carry the assigned APJ's name and department.

The jurisdiction process

  1. Prepare the statewide Judicial Council DE-series forms for your path. If there is a will or codicil, lodge the original with the court before or together with the petition, attached to local form PB-4079 (Will Coversheet); a handwritten will also needs a typewritten copy (Local Probate Rules 1K and 4B).
  2. File the petition. Attorneys and represented parties must e-file through an Odyssey eFileCA service provider, leaving the hearing date, time, and department blank. Self-represented filers may e-file or file on paper at the Probate Clerk's Office, Room 107 (Mon–Thu 8:30 AM – 3:00 PM, Fri 8:30 AM – 12:00 PM), or use the lobby drop box (Mon–Fri 8:00 AM – 5:00 PM).
  3. Pay the $435 filing fee (statewide fee, no Santa Clara County surcharge; fee waivers available on Judicial Council forms FW-001/FW-003).
  4. The clerk assigns the next available hearing date on your assigned department's calendar — Department 2 hears estates Mondays and Thursdays, Department 13 Wednesdays and Fridays, initial Administration of Estate petitions at 9:01 AM — and confirms the date in the e-filing acceptance message. Note dates you are unavailable in the e-filing comments.
  5. Complete notice: publish the Notice of Petition to Administer Estate in a newspaper of general circulation (local form PB-4000 lists qualifying Santa Clara County newspapers) and mail DE-121 notice to heirs and beneficiaries at least 15 days before the hearing.
  6. In uncontested matters, submit your proposed order at least 4 court days before the hearing or the matter may be ordered off calendar (Local Probate Rule 2B).
  7. Check the Advance Case Status Report on the court's website about 2 court days before the hearing. Pre-approved means the petition passed examiner review — no appearance is required, and the order is signed when the calendar is called. If the ACSR lists probate examiner notes instead, file corrective documents before the hearing.
  8. Attend the hearing if required, in person or by Microsoft Teams (find the link through the Remote Hearing Lookup at portal.scscourt.org/remotehearing). The judge admits the will, appoints the personal representative, and issues Letters (DE-150). Non-resident personal representatives should expect a bond requirement even if the will waives bond, unless every heir and beneficiary files a waiver (Local Probate Rule 5B).
  9. Administer and close the estate under the statewide process: creditor notice, the 4-month claim period, Inventory and Appraisal (DE-160), and the petition for final distribution. With all consents and a waiver of accounting (local form PB-4048), the final distribution petition can be submitted ex parte on local form PB-4080 and decided on the pleadings — no closing hearing at all.

Santa Clara County uses the statewide Judicial Council DE-series plus a large catalog of local PB-series forms. Most PB forms cover conservatorships and guardianships; only a handful matter for a decedent's estate, and two are mandatory:

Local forms are downloadable from the Local Forms page at santaclara.courts.ca.gov. The statewide DE-series applies in addition. Ex parte Petitions for Final Discharge (DE-295) are the one exception to the ex parte e-filing procedures — they are submitted in hard copy to the Probate Filing Office.

Timeline

  1. File the petition; the clerk assigns the next available date on your department's estate calendar (Department 2 Mondays/Thursdays, Department 13 Wednesdays/Fridays) and confirms it in the e-filing acceptance message. The court's available-dates schedule notes a high volume of filings, so leave the hearing date blank rather than guessing.
  2. Complete the 15-day mailed DE-121 notice and newspaper publication before the hearing.
  3. The Advance Case Status Report posts about 2 court days before the hearing, no later than 5:00 PM the court day before. Pre-approved matters are granted without an appearance; matters with examiner notes need corrective filings or a continuance.
  4. Hearing to Letters (DE-150): same day to one week for a pre-approved or cleared petition.
  5. Creditor claim period and Inventory and Appraisal deadline: 4 months from Letters (statewide).
  6. Closing: with all consents and a waiver of accounting, the petition for final distribution can be submitted ex parte on PB-4080 and decided on the pleadings, skipping the final hearing entirely.

Local nuance

Santa Clara County-specific considerations

One judge for the whole case. New probate cases are randomly assigned to an All-Purpose Judge under Local Probate Rule 1A. Decedents' estates run through Department 2 (Mondays and Thursdays) and Department 13 (Wednesdays and Fridays), and every document you file must show the assigned judge's name and department in the caption.

Pre-approval means you may never appear. The court posts Advance Case Status Reports for the General Probate and Administration of Estate calendars about 2 court days before each hearing. A pre-approved notation means the petition passed examiner review — no appearance is required and the order is signed at the calling of the calendar. Families without internet access can get ACSR results from Court Services at (408) 882-2515.

The ex parte on-the-pleadings track. Santa Clara decides a notable list of uncontested petitions without any hearing when all consents and waivers of notice are on file: final distribution with waiver of accounting, payment of creditor claims, attorney and administrator fees, will transfers, and spousal property petitions all qualify via local form PB-4080. Preliminary distributions and special administrator appointments go through probate staff attorney review via PB-4078.

Leave the hearing date blank. Because of high filing volume, the court instructs filers to leave the hearing date, time, and department blank; the clerk assigns the next available date, updates availability daily, and confirms the setting in the e-filing acceptance message. Short counter hours, long drop-box hours. The Probate Clerk's Office in Room 107 keeps limited hours — Mon–Thu 8:30 AM to 3:00 PM and Friday mornings only — but the lobby drop box at the Downtown Superior Court accepts filings 8:00 AM to 5:00 PM, Monday through Friday.

Non-resident executors post bond. Under Local Probate Rule 5B the court ordinarily requires a bond from a non-resident personal representative even when the will waives it, unless every heir and beneficiary files a bond waiver — a frequent surprise for out-of-state families.
