Before you begin — know the assets and liabilities
Before you prepare anything for the Montgomery County Clerk and Master, make a complete list of the accounts, real property, vehicles, debts, known heirs and will beneficiaries. Which court handles jurisdiction
Estates of people who lived in Clarksville or anywhere else in Montgomery County are filed through the Montgomery County Chancery Court at the Courts Complex, 2 Millennium Plaza, Suite 101, in Clarksville. Montgomery County has one incorporated city, Clarksville, and the rest of the county is unincorporated. Fort Campbell sits on the Tennessee and Kentucky line at the county's northern edge, so families should be careful to confirm where the person legally lived at death before starting estate settlement.
Tennessee defines the probate court for small estates as the court exercising probate jurisdiction in the county where the decedent had legal residence at death (T.C.A. § 30-4-102). In counties not otherwise changed by public, private, special or local acts, probate jurisdiction is in Chancery Court and the Clerk and Master handles the filing office role (T.C.A. § 16-16-201). Montgomery County's local answer is Chancery Court too: Private Acts of 1981, ch. 106 vested probate jurisdiction in the Chancery Court of Montgomery County and empowered the Clerk and Master to issue letters testamentary and letters of administration under T.C.A. § 30-1-117.

The jurisdiction process
- Identify the assets, debts, will, heirs and beneficiaries before preparing papers. The Montgomery County Chancery rules require a testate petition to name the legatees and devisees, the surviving spouse and next of kin, and require an intestate petition to give approximate real and personal property values and address bond, inventory under T.C.A. § 30-2-301 and accountings.
- Decide whether the matter is a full estate or a small estate under T.C.A. § 30-4-101 et seq. For a full estate, Local Rule 17.01 requires fiduciaries to be represented and requires petitions and motions to be filed by Tennessee counsel, with small-estate applications and adult name changes excepted.
- Prepare the verified petition for letters testamentary if there is a will, or letters of administration if there is not, using T.C.A. § 30-1-117 and the 19th Judicial District Chancery local rules.
- Submit the papers to the Montgomery County Clerk and Master at 2 Millennium Plaza, Suite 101, Clarksville, or use the district's eFlex system if the document and filer are accepted by the system. A will, sworn document or notarized document submitted electronically must be a scanned image of the signed original, and the filer keeps the original.
- Pay the required court costs under T.C.A. § 8-21-401. The county cost sheet effective July 9, 2026 lists a total of three hundred seventy-nine dollars and fifty cents for the probate filing categories on that sheet, including $99.50 in litigation taxes, and says fees should be paid in advance.

An in-order, uncontested common form petition under T.C.A. § 30-1-117 or an intestate petition may be heard by the Court or by the Probate Master under Local Rule 17.03, while a solemn form probate under T.C.A. § 30-1-117, a holographic will or a question of law goes to the Chancellor.
- After approval, the Clerk and Master issues letters testamentary or letters of administration under T.C.A. § 30-1-117. Administration runs from the date the letters issue.
- The clerk handles the notice to creditors under T.C.A. § 30-2-306. Montgomery County's cost sheet effective July 9, 2026 prices publication separately by newspaper, and claims are presented to the Clerk and Master under T.C.A. § 30-2-307.
- If a motion or later estate matter needs a hearing, use the court's notice of hearing form and Local Rule 8.01. The hearing date must be at least five business days after service, and motions are placed on a motion day provided by the Clerk and Master's office.
- For a video request, use the WebEx request or notice form that matches the judge, hearing type or Clerk and Master hearing. Tenn. Sup. Ct. R. 55, adopted by order filed June 8, 2023, makes remote proceedings permissible at the trial court's discretion.
- Administer, account and close under the Chancery rules. Executor duties
Montgomery County adds several local duties and filing expectations to the statewide duties of a Tennessee personal representative. Local Rule 17.01 requires fiduciaries in full estate matters to be represented and requires estate petitions and motions to be filed by Tennessee counsel, with small-estate applications under T.C.A. § 30-4-101 et seq. excepted. A non-lawyer fiduciary may submit annual and final accountings and annual and final fee requests without counsel.
Local Rule 17.03 requires the petition to identify the people with an interest in the estate. For a will, the petition must name all legatees and devisees plus the surviving spouse and next of kin. For an intestate estate, the petition must state the approximate values of the real and personal property, if known, and whether bond, inventory under T.C.A. § 30-2-301 and annual accountings are waived in writing.
Claims are handled through the Clerk and Master. Local Rule 17.07 says verified claims must be presented in triplicate with the required claim fee, and a claim received without the fee is not filed. The statewide claim process is governed by T.C.A. § 30-2-307, and the notice to creditors and four-month publication framework are governed by T.C.A. § 30-2-306.
Reports and reviews have a short local window. Local Rules 17.05 and 17.08 say a Clerk and Master's report stands approved if no exceptions are filed within ten days, and actions of the Clerk and Master are reviewed by the Court through exceptions filed within ten days and a motion for review.

Fees
The clerk's fee for a probate estate is set by state statute at $275, effective January 1, 2026, under 2025 Public Chapter 486 and T.C.A. § 8-21-401. That statute applies to probate estates including general administrations, small estates under T.C.A. § 30-4-101 et seq., insolvent estates and muniment of title under T.C.A. § 32-2-111. State and local litigation taxes and any costs deposit are added under T.C.A. § 8-21-401.

Timeline
- Counter hours are 8:00 a.m. to 4:30 p.m., Monday through Friday, Central time. The Clerk and Master publishes no counter filing cutoff, so call before making a late-day trip.
- Electronic filings through eFlex are treated as filed that day if the entire submission reaches the Clerk before 11:59 p.m. Central time and is approved by the Clerk under the 19th Judicial District electronic filing rules.
- Motions must include a notice of hearing. Local Rule 8.01 says the hearing date must be at least five business days after service, and that motions are heard on a regular motion day provided by the Clerk and Master's office.

Can I look up a Montgomery County estate online?

Can a Montgomery County estate hearing use video?
The court decides. Tenn. Sup. Ct. R. 55, adopted by order filed June 8, 2023, makes remote proceedings permissible at the discretion of the trial court. Montgomery County publishes WebEx request and notice forms, including one for Clerk and Master hearings, and the request form cites Tenn. R. Civ. P. 43.01, effective July 1, 2024.
When are probate motions heard in Montgomery County?
Local Rule 8.01 says motions are heard on a regular motion day provided by the Clerk and Master's office, and the hearing date must be at least five business days after service. The court publishes daily calendars, but it does not publish a fixed probate docket day.
