Before you begin — know the assets and liabilities

Which court handles jurisdiction

Tennessee law sends an estate to the court exercising probate jurisdiction in the county where the person lived at death, which is the venue rule used for small estates and tied to the county of residence (T.C.A. § 30-4-102). Blount County's own probate materials state that the decedent must have been a resident of Blount County at the time of death.

For Blount County, one office serves the whole county: the Clerk and Master's Office in the Blount County Justice Center in Maryville. The county's own site lists Alcoa, Friendsville, Louisville, Maryville, Rockford and Townsend among its cities and towns, but estate papers go to the Maryville office.

Blount County is not a standard chancery filing county for estates. Private Acts of 1947, ch. 345 placed probate jurisdiction in the Court of General Sessions of Blount County, and T.C.A. § 16-16-201 recognizes that Tennessee's chancery default yields where a public, private, special or local act provides otherwise. Locally, the Clerk and Master's Office still takes the filings.

The jurisdiction process

  1. Confirm that the decedent lived in Blount County at death. Blount County's published materials say the decedent must have been a Blount County resident, and Tennessee venue for this filing is tied to the county where probate jurisdiction is exercised (T.C.A. § 30-4-102; T.C.A. § 16-16-201).
  2. Gather the required items before going to Maryville: the original will if there is one, an original death certificate, photo identification, the names and full mailing addresses of beneficiaries and heirs, and a completed Blount County Probate Information Sheet. For a small estate under T.C.A. § 30-4-101 et seq., the county also asks for a list of debts and a list of assets in the decedent's name alone.
  3. If there is no will, call the Clerk and Master's Office at (865) 273-5500 before going in. The county's probate page directs intestate families to call so the office can tell them whether they should consult counsel.
  4. Go to the Clerk and Master's Office at the Blount County Justice Center during business hours. The office no longer schedules in-person appointments, and the county's process requires every personal representative named in the will to come to the office, show photo identification and provide the required names and addresses.
  5. The probate clerk prepares the documents needed to start the case. Blount County publishes a seven-business-day preparation window for those documents.
  6. After the office contacts the personal representatives, review the prepared documents and sign them before one of the office's notaries if they are correct.
  7. Pay the filing fee and any publication charge due under the Blount County schedule effective January 1, 2026, revised June 29, 2026. The schedule lists $345.00 for a testate or intestate estate and $431.40 when publication is included; the statewide statutory clerk's fee component is $275, effective January 1, 2026, under 2025 Public Chapter 486 and T.C.A. § 8-21-401.   9. After the signed order returns to the Clerk and Master's Office, the office prepares the authority documents. Tennessee calls those documents letters testamentary when there is a will and letters of administration when there is not (T.C.A. § 30-1-117). On Blount County's small estate route under T.C.A. § 30-4-101 et seq., the county states that regular letters testamentary or letters of administration are not issued.
  10. Administer the estate, track deadlines, and close the case through the Clerk and Master's Office. For estates requiring publication, Blount County prices publication of the notice to creditors at $86.40 under its schedule effective January 1, 2026, revised June 29, 2026, and the creditor-notice process is governed by T.C.A. § 30-2-306.

Probate forms in Blount County

Tennessee's Administrative Office of the Courts does not publish a statewide probate form set; its self-help center directs estate and probate readers to the clerk in their own county. Blount County answers that locally by publishing the Blount County Probate Information Sheet.

The Probate Information Sheet is required in Blount County. The county lists a completed sheet under what to bring for both a standard estate and a small estate under T.C.A. § 30-4-101 et seq. The form asks for the case type, decedent information, county of residence and death, date of death, will information, whether the will waives bond, inventory under T.C.A. § 30-2-301 or accounting, personal representative information, beneficiary information and closest-relative information.

The cover sheet states that a fax transmission over ten pages, including the cover page, will not be filed unless the court authorizes it.
