A Rogers County probate is filed with the Rogers County Court Clerk at the Rogers County Courthouse in Claremore, in the District Court of Rogers County, which sits in Oklahoma's Twelfth Judicial District together with Mayes and Craig counties.

Venue follows Oklahoma's probate venue rule. If the decedent was an Oklahoma resident, the case belongs in the district court for the county where the decedent resided at death, regardless of where death occurred. If the decedent was not an Oklahoma resident, 58 O.S. § 5 sets the county sequence based on where the decedent died and where Oklahoma estate property is located.

The county lists communities including Claremore, Catoosa, Chelsea, Foyil, Inola, Oologah, Talala and Verdigris. If the decedent lived in Rogers County, the filing is in Claremore even if the family lives closer to Tulsa, Pryor or Vinita.

The jurisdiction process

  1. Gather the death certificate, the original will if there is one, deed information, account information, debts, and names and addresses for heirs and devisees before choosing the court route.
  2. Prepare the petition for the District Court of Rogers County and place the statewide civil cover sheet on top. The probate block on that cover sheet includes PB for probate. The Rogers County Court Clerk does not publish a local probate petition or local probate cover sheet.
  3. File the opening papers with the Rogers County Court Clerk on the second floor of the Rogers County Courthouse, 200 S. Lynn Riggs Blvd in Claremore. A new probate case cannot be opened electronically anywhere in Oklahoma, even though Rogers County allows eligible registered users to e-file into some existing cases.
  4. Pay the filing charge at the Court Clerk counter. Rogers County does not publish its own probate total, so work from the $135.00 probate and guardianship flat fee under 28 O.S. § 152(A)(3), in the version of § 152 last amended effective November 1, 2025, plus statutory costs, and call 918-923-4961 before filing to confirm the amount due.
  5. Have the matter set for the required noticed hearing. Filing questions go to the Court Clerk, not to a judge or judge's staff, and local Rule 1.1 says judicial assignments vary by county and are on file at the Court Clerk's office.
  6. At the hearing, the district judge decides whether to admit the will, if any, and appoint a personal representative. After appointment, letters testamentary or letters of administration issue through the Court Clerk.
  7. Publish and mail the creditor notice required in the case. The notice states the presentment date, and claims not presented by that date are barred forever under 58 O.S. § 333.
  8. Administer the estate, including inventory work, creditor claims, tax and debt issues, and any sale proceeding. If real property is sold inside the probate, Oklahoma imposes a separate $43.00 charge for a probate sale or lease proceeding under 28 O.S. § 152(A)(5), in the version of § 152 last amended effective November 1, 2025.
  9. Ask the Court Clerk when the hearing is set if anyone wants to participate by video. Oklahoma allows videoconferencing in district court, but the presiding judge has discretion under Rule 34, and a party who wants to present testimony remotely must follow that rule.
  10. After the judge rules, prepare the journal entry or decree. The local rules require the journal entry to be submitted to the trial judge and filed within thirty days after the ruling, or, if the parties cannot agree on wording, a Motion to Settle with the proposed journal entry must be filed within that same thirty-day period.
  11. Close the estate with the decree of distribution and discharge. If the estate includes land, record the decree with the Rogers County Clerk on the first floor of the same courthouse, and with the county clerk of any other county where the decedent owned land.

Forms and documents

Probate forms in Rogers County

The Rogers County Court Clerk does not publish local probate forms or a local probate cover sheet. A probate filing is drafted for the estate, and the statewide civil cover sheet is the court form that goes with the filing. On that cover sheet, the probate block includes PB for probate, PC for conservatorship, PG for guardianship, PMI for probate miscellaneous, PT for trust proceedings and FB for full blood.

The Rogers County Clerk is a different office on the first floor. That office publishes recordable documents that often matter in estate settlement, including an Affidavit of Surviving Joint Tenant, a non-spouse version, a Transfer On Death Affidavit, transfer-on-death deed forms, and a deposit-account affidavit written for a bank account of a person who died without a will. These are not Court Clerk probate forms, and they are not a substitute for a petition when a Rogers County court case is needed.

The county's own forms page says the forms are not legal advice and that the office is barred from giving legal advice. Ask the Court Clerk what the filing counter requires, but do not expect court staff to choose the probate route or draft the petition.

Fees

Rogers County does not publish a Court Clerk probate fee sheet. The amount to prepare for is the Oklahoma statutory structure, including the $135.00 probate and guardianship flat fee under 28 O.S. § 152(A)(3), in the version of § 152 last amended effective November 1, 2025, and the $7.00 dispute resolution cost under 12 O.S. § 1809(A), effective under that statute. Section 152 also includes other statutory additions, and § 152(F) allows a county-option courthouse security charge up to $10.00 if approved locally. Rogers County does not publish whether that option has been adopted, so call 918-923-4961 before filing.

If the estate needs a court proceeding to sell or lease real property, personal property or a mineral interest, the statutory charge for that proceeding is $43.00 under 28 O.S. § 152(A)(5), in the version of § 152 last amended effective November 1, 2025.

A person who cannot afford filing costs may file an affidavit in forma pauperis under 28 O.S. § 152(H), in the version of § 152 last amended effective November 1, 2025. The local rules that govern Rogers County add that, when a pauper's affidavit is filed, the Court Clerk informs the assigned judge, the judge may inquire into ability to pay, and the case may be dismissed unless costs and fees are paid if the court finds the party is not entitled to proceed without payment.

Land-records costs are separate. The Rogers County Clerk's recording fee schedule is headed as of November 1, 2019 and lists $18.00 for deeds, mortgages and other recorded documents, $2.00 for each additional page of the same instrument, $1.00 per page for a paper copy, and $1.00 to certify a document. Those amounts apply at the land-records office, not at the Court Clerk filing counter.
