The county's local rules are joint rules of the Seventh and Twenty-sixth Judicial Administrative Districts, which pair Canadian County with Oklahoma County for administrative purposes, but that does not move a Canadian County filing to Oklahoma City.
Oklahoma venue is based on the decedent, not on where an heir lives. If the decedent died as an Oklahoma resident, the proper county is the county where the decedent resided at death, regardless of where death occurred. The jurisdiction process

- The Court Clerk assigns the case randomly to a judge under local Rule 6(A)(1). The matter is set for a noticed hearing before a district judge, who decides whether to admit the will and appoint a personal representative.
- If the court appoints a personal representative, letters testamentary or letters of administration issue. The personal representative then administers the estate, gathers assets, protects property, handles claims and prepares the filings needed to close.
- Publish and mail the notice to creditors as Oklahoma law requires. The notice states a presentment date, and claims not presented by that date are barred forever under 58 O.S. § 333.
- If a hearing date is needed for a motion, local Rule 11 allows the date in Canadian County to be obtained from the assigned judge's staff or from the Court Clerk's office. The presenting party is responsible for notifying the other parties.
- If the estate needs to sell real property inside the probate, the sale proceeding has a separate $43.00 charge under 28 O.S. § 152(A)(5), in the statutory schedule amended effective November 1, 2025.
- Ask about remote participation when the hearing is set. Oklahoma authorizes videoconferencing in district courts, but the assigned judge has broad discretion under Rule 34, and testimony by video requires the Rule 34 notice procedure.
- Close the case with the final accounting or appropriate closing papers, the hearing on distribution, and the decree of distribution and discharge.
- If the estate includes land, record the final decree with the Canadian County Clerk at 314 West Rogers for Canadian County land, and with the county clerk in any other Oklahoma county where the decedent owned land.
