Oklahoma venue is tied to the county of the decedent's residence at death. If the decedent was an Oklahoma resident, the case belongs in the district court for that county; if the decedent was not an Oklahoma resident, Oklahoma law uses the sequence in 58 O.S. § 5(2). Grant County shares Oklahoma's Fourth Judicial District with Alfalfa, Blaine, Dewey, Garfield, Kingfisher, Major, Woods and Woodward counties, but that shared district is a judge assignment structure, not a shared filing counter.

The jurisdiction process

  1. Gather the death certificate, the original will if one exists, account information, deed information, vehicle titles, debts and names and addresses for heirs and beneficiaries.
  2. Decide which Oklahoma route fits before filing. Some property may pass by beneficiary designation, joint ownership, transfer-on-death deed or a no-court affidavit. If court authority is needed, prepare the petition for the District Court of Grant County.
  3. Prepare the Oklahoma civil cover sheet, effective November 1, 2017, and the petition materials required for the chosen route. If there is a will, bring the original will for filing.
  4. File the papers on paper with the Grant County Court Clerk at 112 E. Guthrie Street, Room 202, Medford. Use the P.O. Box for mail only after confirming with the clerk that mailing is appropriate for your filing.
  5. Pay the filing cost. Under the 28 O.S. § 152 schedule amended effective November 1, 2025, the flat probate filing fee is $135.00, plus statutory add-ons. As of August 2026, the Dispute Resolution System cost is $7.00 under 12 O.S. § 1809(A). Call the Grant County Court Clerk for the current total.
  6. Set and give notice of the hearing required for the petition. The district judge, not the court clerk, decides whether to admit the will, appoint the personal representative and issue the order that allows letters to be issued.
  7. If the judge appoints a personal representative, complete the oath and any bond the court orders. The court then issues letters testamentary, letters of administration or letters of administration with will annexed, depending on the case.
  8. Administer the estate. The personal representative identifies assets, prepares any required inventory, publishes and mails creditor notice, states the presentment date, evaluates claims and handles sale issues if property must be sold.
  9. Remember that Oklahoma has a creditor nonclaim rule: claims covered by 58 O.S. § 333 that are not presented by the presentment date stated in the notice are barred forever, subject to the statute's exceptions.
  10. When administration is complete, file the final account and petition for distribution, give required notice and attend the final hearing. After the decree of distribution and discharge is entered, record any decree affecting real property with the county clerk of each county where the land is located.

Do not confuse the Grant County Court Clerk with the Grant County Clerk. The Grant County Clerk is the separate land-records officer and posts land-records templates, including a proof of death and heirship form and a small estate affidavit template.
