Before you begin — know the assets and liabilities
Before you choose a Green County probate path, list the assets, debts, title documents, beneficiary designations and likely creditor issues. The right estate settlement path depends on what is actually subject to administration, not just on what the family believes the person owned.
Sunset's 2,300-institution asset discovery helps families identify accounts and assets before they file in Monroe, so the probate forms, inventory and estate settlement plan are built from a more complete picture.
Which court handles jurisdiction
File a Wisconsin decedent estate for Green County with the Circuit Court for Green County, through the Green County Register in Probate at the Green County Justice Center in Monroe. Green County is a single-county circuit and is not one of Wisconsin's shared two-county circuits.
Wisconsin jurisdiction for administration is in the county where the decedent was domiciled at death. If the decedent had no Wisconsin domicile, jurisdiction may be in a Wisconsin county where the decedent's property is located, and the court that first exercises jurisdiction has exclusive jurisdiction (Wis. Stat. § 856.01).
The jurisdiction process
- Start with the asset list, debts, will, real estate, beneficiary designations and likely creditor issues. Decide whether the Green County matter fits informal administration, formal administration, a transfer by affidavit, summary settlement, summary assignment, or another Wisconsin route.
- Prepare the statewide Wisconsin PR-series forms for the chosen path. For informal administration, the starting form is PR-1801. For formal administration, the petition is PR-1901. Green County does not publish a separate local decedent-estate probate packet.
- File with the Green County Register in Probate at the Green County Justice Center, 2841 6th Street, Monroe, WI 53566. If you submit filings or requests by mail, include a self-addressed, stamped envelope so the office can return processed paperwork, receipts or paperwork that needs correction.
- Account for the statewide estate fee at the inventory stage. Through October 31, 2026, the fee is $20 if the value subject to administration, less encumbrances, liens or charges, is $10,000 or less, and 0.2 percent of that value if it is more (Wis. Stat. § 814.66(1)(a)2, § 814.66(1)(a)3). Effective November 1, 2026, 2025 Wis. Act 179 changes those figures to $36 and $18,500, while the 0.2 percent rate remains the same.
- Handle notice and hearing scheduling. Under Green County Local Rule 502(A), an estate-opening petition with waivers from all interested persons is reviewed in chambers and Domiciliary Letters issue after the paperwork is complete. Under Local Rule 502(B), if notice is given, the return is set for 9:15 a.m. on a Tuesday, and Domiciliary Letters issue after chambers review if no objection is filed.
- If a remote appearance is needed, follow Green County Local Rule 305. Telephone appearances are arranged after consultation with the judicial assistant and other counsel. Zoom appearances may be requested in advance with forms GF-306 and GF-307, and approval is discretionary.
- After appointment, use the Domiciliary Letters, form PR-1810, as the authority document for the personal representative. The inventory is due within a reasonable time and no later than 6 months after appointment unless the court changes the deadline (Wis. Stat. § 858.01).
- Administer and close the estate. Green County Local Rule 503 schedules estate and trust closing hearings on Tuesdays from 9:15 a.m. to 10:00 a.m., or at another available time except Mondays. Closing documents must be filed no later than 4:00 p.m. on the day before the hearing, and Local Rule 503(B) allows telephone testimony about an account by a personal representative if no interested party objects.

| Out-of-state adult child w/ small estate | If Wisconsin property subject to administration does not exceed $50,000 in gross value as of August 2026, transfer by affidavit may be available under Wis. When to hire an attorney
Counsel makes sense in Green County when the estate is contested, real estate must be sold, a creditor or medical assistance issue is disputed, the family needs formal administration, or a remote personal representative needs someone local to handle hearings and filings. In a Wisconsin court proceeding, a personal representative appears by attorney (Wis. Stat. § 879.15(2)); the court system self-help guide says formal administration requires attorney assistance, while informal administration may be granted without attorney assistance. Sunset connects families to a vetted local probate attorney.
