For an informal filing, the registrar, meaning a magistrate judge or district judge and not the clerk, makes the required findings and may issue a written statement of informal probate after five days have elapsed from death, or appoint a personal representative after 120 hours have elapsed from death, subject to Idaho Code § 15-1-307, § 15-3-302 and § 15-3-307.
  6. For a formal filing, the court handles the petition as a formal testacy or appointment proceeding before a judge with notice to interested persons (Idaho Code § 15-1-201, § 15-3-401, § 15-3-402, § 15-3-403). Ask the Latah County clerk how the Second Judicial District will set any hearing.
  7. Ask about remote appearance before the hearing date. Idaho R. Civ. P. 7.2 allows certain hearings by telephone or video teleconference at the court's discretion, and Idaho Code § 15-3-1205 gives a separate appear telephonically option for a surviving-spouse summary administration under Idaho Code § 15-3-1205.
  8. After appointment, use the letters testamentary or letters of administration to collect estate property, manage creditor issues and administer the estate (Idaho Code § 15-1-201, § 15-3-103). Idaho lets a personal representative publish notice to creditors once a week for three successive weeks to start a four-month claim period, and mailed or delivered notice can give a creditor 60 days if that is later (Idaho Code § 15-3-801).
  9. Prepare the inventory within three months after appointment, send a copy to interested persons who request it, and remember that filing the original inventory with the court is allowed but not required by Idaho Code § 15-3-706. When administration is complete, close the estate under the applicable Idaho procedure.
