Before you begin — know the assets and liabilities

Before you file anything in Sandpoint, make a list of the decedent's assets, debts, beneficiary designations, co-owned property and known creditors. Idaho venue turns on the decedent's domicile at death, and the right Bonner County filing path depends on whether there is a will, whether an original will must be lodged, whether real property is involved and who is asking to act as personal representative (Idaho Code § 15-3-201).

Which court handles jurisdiction

V, § 20; Idaho Code § 1-2201, § 1-2208). The papers are filed with the clerk of the district court at the Bonner County Courthouse.

Bonner County is in Idaho's First Judicial District, which includes Benewah, Bonner, Boundary, Kootenai and Shoshone Counties. The district has eight district judges, and two resident district-judge chambers are established in Bonner County (Idaho Code § 1-802). The district organizes judges and local rules; it does not move a Bonner County estate filing to another county.

Venue for the first informal or formal testacy or appointment proceeding is the county where the decedent was domiciled at death. If the decedent was not domiciled in Idaho, venue may be in a county where the decedent had property (Idaho Code § 15-3-201). Bonner County communities include Sandpoint, Ponderay, Kootenai, Dover, Priest River and Oldtown.

The jurisdiction process

  1. Choose the filing path. Informal probate uses an application; formal probate uses a petition; a surviving spouse who is the sole beneficiary may need to ask about summary administration under Idaho Code § 15-3-1205, including the debt-liability rule in that section. If personal property can be collected without opening a case, the collection of personal property by affidavit is governed by Idaho Code § 15-3-1201.
  2. Prepare the Bonner County filing. Bonner County does not list a county probate packet on its courts page or Court Assistance Office page, and the Court Assistance Office at courtselfhelp.idaho.gov does not list a full probate packet. A personal representative or attorney drafts the application or petition under Idaho Code Title 15, chapter 3.
  3. File with the clerk of the district court at the Bonner County Courthouse, 215 South 1st Avenue, Sandpoint. Attorneys must use electronic filing under the Idaho Rules for Electronic Filing and Service. A self-represented personal representative may use iCourt File and Serve or file on paper with the clerk, but choosing electronic filing is a one-way election for the life of the case unless the court allows withdrawal (I.R.E.F.S. Rule 4).
  4. Pay the filing fee. The fee to open an informal or formal probate is $166.00, effective July 12, 2024, under the Idaho Supreme Court schedule and Idaho Code § 31-3201A, § 1-2003, § 73-213 and § 31-3201. If you cannot prepay fees, ask the clerk about the affidavit and court-finding process under Idaho Code § 31-3220.
  5. If there is a will, handle the original correctly. If the case is e-filed, the original will must also be filed conventionally within seven business days (I.R.E.F.S. Rule 5(a)).
  6. For informal probate, the registrar, meaning a magistrate judge or district judge and not the clerk, makes the statutory findings and may issue a written statement of informal probate after the required waiting period (Idaho Code § 15-1-307, § 15-3-302). For informal appointment, the registrar may appoint the personal representative after the waiting period in Idaho Code § 15-3-307.
  7. For formal probate, follow the court's notice and hearing process. Formal proceedings are conducted before a judge with notice to interested persons, and Idaho has an uncontested formal-probate route (Idaho Code § 15-1-201, § 15-3-401, § 15-3-405).
  8. Ask before planning on a remote hearing. Idaho R. Civ. P. 7.2 allows the court to hold certain hearings by telephone or video teleconference at the court's discretion. In a surviving-spouse summary administration, the statute also allows a proper motion to appear telephonically or affidavits in place of personal attendance (Idaho Code § 15-3-1205).
  9. After appointment, use the correct authority document. Idaho letters include letters testamentary when there is a will and letters of administration when there is no will (Idaho Code § 15-1-201, § 15-3-103).
  10. Administer and close the estate. Prepare the inventory within three months after appointment, send it to interested persons who request it, and remember that filing the inventory with the court is permissive under Idaho Code § 15-3-706. Idaho allows publication of notice to creditors to start the four-month claim period, with a 60-day mailed-notice rule for actual-notice creditors (Idaho Code § 15-3-801).
