Which court handles jurisdiction

Idaho has no separate court for decedents' estates: probate is a case class assigned to the magistrate division of the district court, which sits in every one of Idaho's 44 counties, and a magistrate judge hears it (Idaho Const. art. V, § 20; Idaho Code § 1-2201, § 1-2208). The papers are filed with the clerk of the district court at the Elmore County Courthouse.

Venue for the first informal or formal testacy or appointment proceeding is in the county where the decedent had domicile at death, or, if the decedent was not domiciled in Idaho, in a county where the decedent's property was located (Idaho Code § 15-3-201). The jurisdiction process

  5. Handle notice and hearing issues for the path you chose. Formal proceedings are before a judge with notice to interested persons (Idaho Code § 15-1-201(20)). For creditor claims, Idaho lets a personal representative publish notice to creditors to start a 4 months claim period after first publication, with mailed or delivered notice handled under Idaho Code § 15-3-801.
  6. If a hearing is set and travel is difficult, ask the court before the hearing date. Idaho R. Civ. P. 7.2 allows the court to hold certain matters by telephone or video teleconference, and Elmore County publishes a Virtual or Telephone Appearance Request process using a Generic Motion and Generic Order.
  7. After appointment, qualify and obtain the authority document. Idaho uses letters testamentary when there is a will and letters of administration when there is no will (Idaho Code § 15-1-201); administration begins with issuance of letters after appointment and qualification (Idaho Code § 15-3-103).
  8. Administer the estate and keep deadline control. Prepare the inventory within three months after appointment, send it to interested persons who request it, and decide whether to file it with the court as permitted by Idaho Code § 15-3-706.
  9. Close the estate under the Idaho procedure that fits the case. If the estate is handled through summary administration, the closing statement provisions are in Idaho Code § 15-3-1204; otherwise, use the closing route that matches the court order and the administration path.
