For article 2 estates, W. Va. Code § 44-2-1 uses a $200,000 referral threshold for probate assets, excluding real estate specifically devised and nonprobate assets.
  9. Finish administration by collecting assets, paying allowed claims and expenses, and distributing what remains. In the article 2 path, the closing paper is usually a waiver of final settlement under W. Va. Code § 44-2-29 or a report of receipts, disbursements, and distribution under W. Va. Code § 44-2.
  10. If someone objects to the will, that will contest is filed in circuit court under W. Va. Code § 41-5-11. An appeal from the Wetzel County Commission's probate order under W. Va. Code § 7-1-3 goes to circuit court under W. Va. Code § 58-3-1.
