Which court handles jurisdiction

If the decedent lived in Jackson County, you file in Ripley with the Jackson County Clerk or the Jackson County Fiduciary Supervisor's office. W. Va. Code § 41-5-4 puts the will before the county commission of the county where the person had a mansion house or known place of residence at death, and W. Va. Code § 44-1-4 puts an intestate estate in the same place.

West Virginia probate is not a court proceeding for a routine estate. The Jackson County Commission holds probate jurisdiction under W. Va. Code § 7-1-3, and the elected Jackson County Clerk admits the will to record under W. Va. Code § 41-5-10 while the Jackson County Fiduciary Supervisor's office administers article 3A estate files under W. Va. Code § 44-3A.

The jurisdiction process

  8. If no objection or dispute requires referral, close the article 3A estate with the Jackson form the office directs, usually a short form settlement under W. Va. Code § 44-3A-4a when there are no outstanding debts or disputes, or a long form settlement when certified mailing and an objection period are needed.
  9. If someone objects, a claim dispute arises, or the estate is referred under W. Va. Code § 44-3A, the matter may go to a fiduciary commissioner under W. Va. Code § 44-3.
