- Receive authority if appointed. In an informal proceeding, the clerk of courts may issue the written statement of informal probate once the requirements are met and at least 120 hours have passed since death (SDCL 29A-3-302). Administration begins when letters testamentary or letters of administration are issued after the personal representative qualifies (SDCL 29A-3-103).
- Administer and close the estate. The personal representative gathers assets, deals with creditors and beneficiaries, follows South Dakota notice and estate-administration rules, and closes the estate through the appropriate South Dakota procedure.
