The court serves Jackson County, including the city of Jackson, the villages of Brooklyn, Concord, Parma, and Springport, and the townships of Blackman, Columbia, Grass Lake Charter, Hanover, Henrietta, Leoni, Liberty, Napoleon, Norvell, Rives, Sandstone Charter, Spring Arbor, Springport, Summit, Tompkins, and Waterloo.

Michigan venue for the first informal or formal testacy or appointment proceeding is the county where the decedent was domiciled at death, or, if the decedent was not domiciled in Michigan, a county where the decedent's property was located at death (MCL 700.3201). For an out-of-state owner of property in the Irish Hills area of Jackson County, the property branch may matter.

The jurisdiction process

  1. List the decedent's assets, debts, funeral expenses, will status, heirs, and beneficiaries before choosing a path. This is the first estate settlement step because the form packet and filing fee depend on what the estate owns and what authority is needed.
  2. Choose the correct Michigan procedure. An informal estate uses PC 558 and is acted on by the probate register if it qualifies. A formal estate uses PC 559 and goes before a judge. Assignment of property uses PC 556 and, for a 2026 death, is tied to the $53,000 limit under MCL 700.3982. Transfer by affidavit uses PC 598 and, for a 2026 death, is tied to the $53,000 limit under MCL 700.3983, but it is not filed with the court.
  3. Start with the Jackson County packet when one exists. The court publishes packets for informal estates, assignment of property, successor personal representative filings, reopening an estate, and withdrawing a will held for safekeeping.
  4. Prepare the statewide SCAO forms and the Jackson County packet requirements. For an informal estate, the court asks for two copies of the death certificate, one with protected personal identifying information redacted, and the original will if there is one and the court does not already hold it. For assignment of property, the court asks for PC 556, two death certificate copies with protected information redacted from one, proof of all funeral expenses, and proof of who paid them if they have been paid.
  5. File on paper with the Jackson County Probate Court, Jackson County Courthouse, 312 S. Jackson Street, 1st Floor, Jackson, MI 49201. You may file at the counter during open hours or by mail. No probate filing is accepted by fax or email, and this probate court is not on MiFILE.
  6. Plan around the counter rules. The office closes from 11:30 a.m. to noon every weekday, closes at 2:00 p.m. on Tuesday and Thursday, and does not accept new case filings after 3:30 p.m. Court staff cannot make copies. Paperwork must be single-sided, legible, and typed or written in ink. If you file by mail and want stamped copies returned, include a self-addressed stamped envelope.
  7. Pay the statutory fee. For 2026, opening a decedent estate costs $175.00, consisting of a $150.00 probate commencement amount (MCL 600.880) plus a $25.00 electronic filing system fee (MCL 600.1986). A 2026 assignment of property petition costs $25.00 (MCL 600.880(2)). Cash payments must be exact, and the court's packets state that fees are not returned if the filing is denied.
  8. Serve the required notices. After an informal probate is granted, the applicant must give written information of the probate within 28 days as required by MCL 700.3306. After appointment, the personal representative handles creditor notice, known creditor notice, and proof of service. Jackson County's own packet warns that not filing proof of service may lead to dismissal or removal of the personal representative.
  9. Attend a hearing only if one is required. Many informal estates are handled by the probate register without a hearing. If a hearing is scheduled, follow the notice of hearing and the court's videoconference instructions. The court uses a virtual waiting room and expects courtroom conduct and attire even by video.
  10. After appointment, obtain certified copies of the letters of authority if needed. For 2026, certified copies cost $10.00 for certification plus $1.00 per page (MCL 600.2546).
  11. Administer and close the estate. The personal representative files the inventory information within 91 days of letters of authority under MCR 5.307, pays the inventory fee under MCL 600.871, manages creditor claims and distributions, and closes through the Michigan closing procedure that fits the estate.

Executor duties

Michigan calls the role the personal representative, even though many families still say executor. In Jackson County, the local duties that most often trip up a personal representative are practical filing duties: use single-sided legible paper, make your own copies before filing, include a self-addressed stamped envelope if filing by mail and requesting stamped copies back, keep fax and email out of the filing plan, and file proof of service after appointment.
