Before you begin — know the assets and liabilities
Before you file in Calhoun County, identify what the decedent owned, how each asset was titled, what debts exist and whether anything passes by beneficiary designation or joint ownership. Those facts determine whether a court estate is needed and what the representative must ask the Circuit Court to authorize.
Sunset's estate settlement tools help families search for accounts across more than 2,300 institutions, organize liabilities and decide what belongs in the Calhoun County filing. Do that inventory work before paying a filing fee or mailing the original will to Hardin.
Which court handles jurisdiction
One courthouse serves Calhoun County probate matters: the Calhoun County Courthouse at 101 North County Road in Hardin. The page covers estates connected to Hardin, Kampsville, Hamburg and the surrounding rural townships in Calhoun County.
Calhoun County is part of the Eighth Judicial Circuit with Adams, Schuyler, Mason, Cass, Brown, Pike and Menard Counties. The circuit shares judges and administration, but it does not share one probate filing counter. File a Calhoun County estate with the Calhoun County Circuit Clerk in Hardin.
Illinois venue starts with the county where the decedent had a known place of residence. If there was no known Illinois residence, venue moves to the county with the greater part of the real estate, then to the county with the greater part of the personal estate (755 ILCS 5/5-1).
The jurisdiction process
- Locate the will and identify the proper county. Anyone holding the will must file it with the Circuit Clerk immediately after death (755 ILCS 5/6-1). A person named as executor has 30 days after learning of the appointment to open a case or decline under 755 ILCS 5/6-3. Use Calhoun County only if venue belongs there under 755 ILCS 5/5-1.
- Prepare the petition and supporting documents. Calhoun County does not publish a decedent-estate form packet. The petition, proposed order, oath, bond materials, heirship proof and any drafted notices must fit the Illinois Probate Act of 1975 and the Eighth Judicial Circuit probate rules.
- E-file the petition and deliver the original will. E-file the petition through eFileIL unless you qualify for an exemption under Illinois Supreme Court Rule 9(d). The original will cannot be e-filed under Rule 9(c)(1), so deliver or mail it to the Calhoun County Circuit Clerk at 101 North County Road or P.O. Box 486 in Hardin.
- Confirm and pay the filing fee. Calhoun County does not publish an online probate fee schedule. Call the Circuit Clerk before filing because county circuit clerk fees are set under 705 ILCS 105/27.1b.
- Prove heirship and ask for letters of office. Present heirship evidence as required by 755 ILCS 5/5-3 and local Rule 8.1. If the court grants authority, it issues letters of office under 755 ILCS 5, which are the representative's proof of authority.
- Address independent administration or supervision. Illinois courts grant independent administration under Article XXVIII unless the will forbids it or an interested person objects in a way the statute recognizes (755 ILCS 5/28-2). If supervised administration is required, supervision is the non-Article XXVIII path under the Probate Act.
- File the oath and handle any bond requirement. An Illinois representative takes an oath and gives bond unless the will or court treatment changes the bond requirement (755 ILCS 5/12-2).
- Give notice after the order. Within 14 days after the order admitting a will or appointing a representative, mail the petition and order to heirs and legatees whose addresses are stated, with publication where an address is not stated (755 ILCS 5/6-10).
- Publish the creditor notice. Publish the claims notice once each week for 3 successive weeks in a newspaper published in the county where the estate is being administered, then file proof of publication. The claims date is at least six months from first publication or 3 months from mailing or delivery, whichever is later (755 ILCS 5/18-3). Under local Rule 8.1, the representative directs the clerk which newspaper to use.
- Inventory, pay claims and close the estate. Prepare the inventory under Article XIV and local Rule 8.3, pay allowed claims, keep accounting records and prepare the account under Article XXIV and local Rule 8.9. Any fee request must follow local Rule 8.11 before the estate closes.
Forms and documents
Probate forms in Calhoun County
No Calhoun County probate packet, cover sheet, decedent-estate petition, proposed order, oath, inventory, account form or small-estate template is published by the Circuit Clerk. Illinois also has no statewide standardized forms for decedents' estates, so the petition, order, oath, inventory and account are drafted for the case.
The Eighth Judicial Circuit Uniform Rules of Practice, Part 8, explain how probate matters are presented in Calhoun County. Those rules address proof of heirship, bonds and sureties, inventories, claims, accounts and fee petitions, but they do not provide fill-in-the-blank forms.

Local nuance
Calhoun County-specific considerations
The Eighth Judicial Circuit Uniform Rules of Practice include a dedicated Part 8 for probate matters in Calhoun County. The rules are circuit-wide, so they apply in Calhoun County along with statewide Illinois probate statutes.
| Local rule | What it means in Calhoun County |
|---|---|
| Rule 8.1, probate proceedings | The estate representative or attorney is responsible for giving proper notice, presenting evidence and conducting probate proceedings unless the law places that responsibility on the court or clerk. The representative gives the clerk a direction naming the newspaper for probate notices when letters of office are issued under 755 ILCS 5. |
| Rule 8.1, heirship | On a petition for letters of administration to collect, proof of heirship is given before letters of office issue unless the court waives it. |
| Rule 8.3, inventory and appraisal | The inventory must describe real estate and improvements, any indebtedness on real estate, money on hand and personal estate, with item numbers carried into the final accounting. Under independent administration under Article XXVIII, the representative is not required to file the inventory with the court. |
| Rule 8.4, claims | A claim based on a written instrument must include a copy of the instrument. If the representative or the attorney files a claim against the estate, the representative must ask the court to appoint a guardian ad litem or special administrator to defend for the estate. |
| Rule 8.9, accounts | A final account, or a current account intended to bind interested persons, must be sent with written notice that approval will be binding absent fraud, accident or mistake. Proof of notice is filed with the clerk on or before the hearing date unless a person files a receipt in full or written waiver. |
| Rule 8.11, fees | Fees in a deceased person's estate are allowed by written petition or statement listing the estate value for tax purposes, services, hours, hourly charge, requested fee and costs advanced, unless all interested parties appear and agree. |
