Before you begin — know the assets and liabilities

Before anyone files in Lake County, identify the assets, debts, beneficiary designations, real estate and the location of the original will. The choice between an affidavit, an attorney-filed petition, independent administration under 755 ILCS 5/Art. XXVIII, supervised administration or another path depends on what the decedent owned and who can legally collect it.

Which court handles jurisdiction

Lake County is a single-county circuit: the Nineteenth Judicial Circuit is Lake County alone under 705 ILCS 35/1. Decedent-estate filings go to the Lake County Circuit Clerk, and probate hearings are in Courtroom C-303 at the Main Courthouse in Waukegan.

Illinois venue is based on the county, not on a multi-county circuit. Probate or administration belongs first in the county of the decedent's known Illinois residence, then the county with the greater part of the decedent's Illinois real estate, then the county with the greater part of the decedent's personal estate (755 ILCS 5/5-1). The Lake County Clerk's Wills and Probate page states the local point as the deceased having been a Lake County resident.

Lake County communities include Waukegan, North Chicago, Zion, Winthrop Harbor, Beach Park, Gurnee, Libertyville, Mundelein, Vernon Hills, Grayslake, Round Lake, Lake Villa, Antioch, Wauconda, Lake Zurich, Lake Bluff, Lake Forest, Highland Park and Deerfield.

The jurisdiction process

  1. Find the original will and file it with the Lake County Circuit Clerk's Probate Division if the decedent left one. Illinois law says the holder files the will immediately after death under 755 ILCS 5/6-1. The Clerk says the original will may be mailed, and filing the will alone is $0.00, effective October 1, 2025.
  2. Confirm that Lake County is the proper county. Venue is based first on the decedent's known Illinois residence, then the county with the greater part of Illinois real estate, then the county with the greater part of personal estate (755 ILCS 5/5-1).
  3. Work with an Illinois probate attorney if a petition for probate and letters of office under 755 ILCS 5 is needed. The Lake County Circuit Clerk states that petitions for probate must be filed by an attorney and that a self-represented litigant must hire one before opening a petition for probate.
  4. Prepare the Lake County opening documents, usually including the Petition for Probate and for Letters, Exhibit A, affidavit of heirship, waivers or notices, the filed original will if any, proposed Order Declaring Heirship, proposed Oath of Office and Bond, and proposed Order Appointing Representative of Decedent's Estate.
  5. E-file the petition package through eFileIL. The decedent-estate opening fee is $384.00, effective October 1, 2025. Any non-exempt appearance fee is $209.00, effective October 1, 2025. Lake's schedule identifies these as Schedule 2 and Schedule 1 items under 705 ILCS 105/27.1b.
  6. Call the Probate Division at 847-377-3260 for the court date. Lake says court dates cannot be set online, and the petition must be filed before a court date is received.
  7. Deliver the opening package to the judge seven days before the court date. Proposed orders are uploaded through the eCourt portal one time only, 24 hours before the court date.
  8. Attend the opening call in Courtroom C-303. Openings of decedent estates are called on Mondays, Tuesdays and Thursdays at 8:50 a.m. Uncontested matters may proceed by Zoom, and attorneys may be able to use the off-call procedure for eligible uncontested openings.
  9. After appointment, obtain letters of office under 755 ILCS 5. Additional certified copies of letters of office cost $2.00 per copy up to 3 pages, effective October 1, 2025, and $1.00 per page if over 3 pages, effective October 1, 2025, under 705 ILCS 105/27.1b and the Lake fee schedule.
  10. Publish and mail creditor notice. Under 755 ILCS 5/18-3, the claim date must be not less than 6 months from first publication or 3 months from mailing or delivery, whichever is later. Lake's Clerk points probate filers to the Daily Herald for publication, and publication is paid to the newspaper.
  11. Administer the estate, handle claims, inventory and accounting, and file annual status reports or accountings when required by Lake local rule. Independent administration under 755 ILCS 5/Art. XXVIII still has Lake's annual status-report requirement.
  12. Close the estate with the Lake County closing documents. The closing package includes the final report, receipts, consent and waiver documents, proof of publication if required, claim dismissals or releases if applicable, and a proposed Order of Discharge. Closing decedent estates is called at 8:50 a.m. on Mondays, Tuesdays and Thursdays, unless an eligible attorney-only off-call closing is used.

Executor duties

Lake County adds several local court-management duties on top of the statewide duties of an executor or administrator. Every decedent estate must file an annual status report, and a supervised estate must file an annual accounting. If the required report or accounting is not filed, the case can be placed on a citation call.

Local rule 5-3.06 requires annual reports or accounts to continue until the estate is closed. Local rule 5-3.13 says closing will not be authorized unless receipts or other proof of distribution are on file, a verified final report has been filed, costs and claims have been handled, and applicable taxes have been paid or provided for, or the estate is not subject to death taxes.

Lake also has local rules for safe deposit boxes, claim calls, vouchers, fee petitions and jury demands in probate matters. If a decedent had a safe deposit box, local rule 5-3.05 requires the representative to identify the box and prepare an itemized statement of its contents.

Probate forms in Lake County

Illinois does not provide a Supreme Court approved decedent-estate packet for admitting a will, opening an estate, inventory, accounting or closing. Lake County fills that gap with local probate forms through the Circuit Clerk.

Timeline

  1. Before filing, gather the will, asset information, debts, heirs, legatees and title information. If only an original will is being deposited, the filing is $0.00, effective October 1, 2025, and is handled under 755 ILCS 5/6-1.
  2. At filing, the Clerk stamps an initial case management conference date in probate decedent-estate and guardianship cases. Local rule 5-2.11 says that date is about 75 days from filing, but the standing order says it is not the date to open the estate or hold a hearing.
  3. After the petition is filed, call the Probate Division at 847-377-3260 to schedule the opening date. The Clerk says all dates must be called in and cannot be set online.
  4. Seven days before the opening or closing date, the required package must be physically received by the judge. In contested matters, physical courtesy copies of pleadings and notices of motion are also required seven days before the court date.
  5. Twenty-four hours before the court date, proposed orders are uploaded through the eCourt portal one time only. Morning-call orders are submitted and uploaded by 2:00 p.m. the same day.
  6. For decedent estates, openings and closings are called in C-303 on Mondays, Tuesdays and Thursdays at 8:50 a.m. Routine decedent-estate motions are at 9:00 a.m. on those same days.
  7. Creditor notice follows 755 ILCS 5/18-3. The claim date must be not less than 6 months from first publication or 3 months from mailing or delivery, whichever is later.
  8. Annual Lake County status reports or accountings continue until the estate closes. If a required report or accounting is missed, the case can appear on a citation call on the first Tuesday of the month at 9:00 a.m.

Small-estate Alternatives

Lake County publishes its own Small Estate Affidavit form under 755 ILCS 5/25-1. The local point is practical: the affidavit is not filed with the Lake County Circuit Clerk to open a probate case. It is presented to the bank, transfer agent or other holder of personal property.

Lake's form also names the Clerk of the Circuit Court of Lake County, Nineteenth Judicial Circuit, as the default agent for service of process if the affiant does not name another agent. The affidavit cannot transfer real estate.
