Hunterdon County, NJ Probate Information

Before you go to the Hunterdon County Surrogate, know exactly what is in the estate. The path - probate of a will, general administration when there is no will, administration with the will annexed, or one of New Jersey's intestate affidavit-in-lieu paths - depends entirely on whether there is a will and on the value and type of the assets. Hunterdon's own information sheet asks you to identify each survivor and next of kin with a full address and to list assets, so arriving with a complete asset and debt picture and the right sheet saves a return trip.

Identify every bank account, credit-union account, retirement plan, brokerage holding, life-insurance policy, vehicle, and parcel of real property, along with every debt, before you qualify. Hunterdon issues one probate (short) certificate with the base fee and $5 for each additional, so knowing how many banks, titles, and properties are involved tells you how many to order. The Hunterdon County Surrogate's Court serves the entire county from one office at the Hunterdon County Justice Center in Flemington, covering Flemington, Clinton, Lambertville, Raritan Township, Readington, Union Township, Delaware Township, Kingwood, East Amwell, West Amwell, Tewksbury, and the county's remaining rural municipalities. Uncontested probate and administration are filed here when the decedent was domiciled in Hunterdon County at death (R. 4:80-1(c)); if the decedent had no New Jersey domicile, venue lies in any county where New Jersey property is located.

The Surrogate is an elected constitutional officer (N.J.S.A. 2B:14-1) who serves as both Judge and Clerk of the Surrogate's Court and, per the New Jersey Judiciary, as Deputy Clerk of the Superior Court, Chancery Division, Probate Part. The Surrogate handles only uncontested matters. If a caveat is filed, or a matter otherwise becomes contested - a will contest, a fiduciary removal, a formal accounting - the case moves to the Superior Court, Chancery Division, Probate Part in the Somerset, Hunterdon and Warren Vicinage (Vicinage 13), where counsel is effectively required.

Cash, check, or credit card. Unlike some New Jersey Surrogates, Hunterdon accepts credit cards (Visa, Mastercard, Discover) as well as cash and checks made payable to Hunterdon County Surrogate.

Information sheets can be started online. Hunterdon posts its Probate, Administration, C.T.A., ad prosequendum, and small-estate affidavit information sheets as both online submittable forms through the county Form Center and printable PDFs. You can complete and submit the sheet online, but there is no eProbate that finishes the case; the executor or administrator still qualifies in person, and New Jersey's Superior Court e-filing system does not handle estate cases.

One certificate is included; do not over-order. The base probate or administration fee includes one probate (short) certificate. Hunterdon's own fact sheet advises ordering only what each bank, vehicle title, and property actually needs, since asset-holders treat the certificates as time-limited, and notes you can request additional certificates later.

Small-estate affidavit fee is asset-based. For the intestate affidavit-in-lieu paths, Hunterdon charges $5 per $100 of estate assets, capped at $50, rather than a flat fee. The estate-value limits themselves are statewide and are covered on the New Jersey state page.

Records are searched by staff, not online. There is no public online case portal. Estate records are searched by office staff for $10 per estate, and permanent will and estate administration records are kept on microfilm, which the office notes are also useful to title searchers and genealogists.

Contested matters leave the county. A caveat or other contested matter routes to the Superior Court, Chancery Division, Probate Part in the Somerset, Hunterdon and Warren Vicinage (Vicinage 13); the vicinage's General Equity office is reached at (908) 332-7700 ext. 13780.

Most Hunterdon County estates are uncontested and are completed by qualifying in person at the Surrogate's office, without an attorney.
