Before you begin — know the assets and liabilities

The most common Gloucester County probate mistake is booking the appointment before the family understands the inheritance-tax exposure. The Gloucester County Surrogate's Court in Woodbury serves the entire county, including Woodbury, Deptford, Washington Township, Monroe, Glassboro, Franklin, West Deptford, Mantua, Pitman, Clayton, Paulsboro, Swedesboro, Logan, and East Greenwich. Every uncontested Gloucester probate and intestate administration is handled at the one office at 17 North Broad Street. Venue lies in the county where the decedent was domiciled at death (R. 4:80-1(c)); if the decedent lived outside New Jersey but owned Gloucester County real estate, the estate proceeds here by ancillary administration.

The Surrogate is an elected constitutional officer (N.J.S.A. 2B:14-1) who serves as both Judge and Clerk of the Surrogate's Court and, per the New Jersey Judiciary, as Deputy Clerk of the Superior Court, Chancery Division, Probate Part. The Surrogate handles only uncontested matters. A caveat filed at the Surrogate's office, a will contest, a demand for a formal accounting, or removal of a fiduciary routes the matter to the Superior Court of New Jersey, Chancery Division, Probate Part, in the Cumberland, Gloucester and Salem Vicinage, where counsel is effectively required.

The jurisdiction process

  1. Confirm the matter is uncontested and that venue is Gloucester County (the decedent was domiciled here at death, R. 4:80-1(c)). Gather the original last will and any codicils, an original death certificate with a raised seal, the executor's or administrator's government-issued photo ID, and the names and addresses of the next of kin and beneficiaries.
  2. Complete the Gloucester Surrogate's New Estate Information Form, the single intake document used for all estate matters. You may submit it in advance by email, mail, or fax with a copy of the death certificate and will, or bring it to your appointment.
  3. Call (856) 853-3282 to schedule an appointment; the office is open by appointment only. Uncontested matters are then qualified at the counter at 17 North Broad Street, Woodbury. There is no e-filing for Surrogate probate.
  4. Mind the waiting periods: for a will, the Surrogate cannot issue a short certificate until the eleventh day after death (N.J.S.A. 3B:3-22); for an intestate estate, the office states the administration cannot be issued until the sixth day from the date of death. You may prepare and submit papers before then.
  5. Qualify at your appointment. Take the oath and, if you are serving as administrator of an intestate estate, post the required surety bond first (N.J.S.A. 3B:15-1) unless a statutory exception applies, such as a surviving spouse entitled to the entire estate.   7. Mail the Notice of Probate to all beneficiaries and heirs within 60 days of probate and file the Proof of Mailing with the Surrogate within 10 days of mailing (R. 4:80-6). If a charity is a beneficiary, mail like notice and a copy of the will to the New Jersey Attorney General. The office publishes a combined Notice of Probate / Proof of Mailing form.
  8. Administer and close the estate: creditors have 9 months from the date of death to present claims (N.J.S.A. 3B:22-4); obtain inheritance-tax waivers (L-8, L-9, or O-1) to release frozen accounts and real estate; record any L-9 or O-1 real-property waiver with the Gloucester County Clerk before conveying local real estate; and collect a Refunding Bond and Release from each beneficiary before closing (N.J.S.A. 3B:23-24).

Administration waits until the sixth day. For a will, the Surrogate cannot issue a short certificate until the eleventh day after death (N.J.S.A. 3B:3-22). For an intestate estate, the office states the administration cannot be issued until the sixth day from the date of death. Plan the appointment accordingly.

An after-hours drop box is available. The office keeps a secure drop box near its rear entrance for original documents, which can help executors who cannot hand-deliver during business hours.

Credit cards are accepted. Unlike some smaller New Jersey Surrogate offices, Gloucester accepts Visa, Mastercard, and Discover in addition to check and cash for its fees.

Bank accounts may be released only in part until a waiver clears. A New Jersey financial institution may release up to 50% of a bank account or CD to the survivor or estate representative without the Director's consent (N.J.A.C. 18:26-11.16).
