Before you begin — know the assets and liabilities

Before you choose a probate path in Sheridan County, list the assets, debts, account titles, beneficiary designations, and real property. Nebraska separates informal probate, formal probate with notice, and affidavit routes, so the right estate settlement path depends on what actually needs to be transferred.

Sunset can help organize the asset search before you contact the clerk or an attorney. Sunset's asset discovery checks more than 2,300 institutions, which helps families find accounts, insurance, investments, and debts before a Sheridan County filing is prepared.

Which court handles jurisdiction

Probate for Sheridan County is filed with the clerk of the Sheridan County Court at 301 East 2nd Street in Rushville, with mail sent to P.O. Box 430, Rushville, NE 69360. Nebraska district courts do not hear probate; a will is proved and letters are issued in the county court, which has exclusive original jurisdiction of all matters relating to decedents' estates (Neb. Rev. Stat. § 24-517).

Sheridan County sits in Nebraska's twelfth county judge district. A county judge district assigns county judges and the county court's local rules; it does not create a different filing counter for a Sheridan County estate (Neb. Rev. Stat. § 24-502, § 24-503).

Venue for the first informal or formal testacy or appointment proceeding is the county where the decedent had domicile at death, or, if the decedent was not domiciled in Nebraska, any county where the decedent had property at death (Neb. Rev. Stat. § 30-2410).

The jurisdiction process

  1. Choose the opening path. Informal probate uses an application to the registrar; formal probate uses a petition to the court and proceeds with notice. In an informal proceeding, the registrar's acts are performed by a county judge or by a person designated by the court in a written order, and the application is delivered to the clerk of the Sheridan County Court (Neb. Rev. Stat. § 30-2216).
  2. Gather the death certificate, the original will if there is one, a list of heirs and devisees, known debts, and asset information. If the estate settlement may qualify for an affidavit route, check the personal-property affidavit under Neb. Rev. Stat. § 30-24,125 and the real-property affidavit under Neb. Rev. Stat. § 30-24,129 before opening a court case.
  3. Deliver the application or petition to the clerk of the Sheridan County Court at 301 East 2nd Street in Rushville, mail it to P.O. Box 430, Rushville, NE 69360, or, if you are filing without a lawyer, fax it to 308-327-5623 with the uniform cover sheet required by Neb. Ct. R. § 6-601(B). A Nebraska attorney must use electronic filing under Neb. Ct. R. § 2-202. Email submissions are not court filings under Neb. Ct. R. § 2-212.
  4. Pay the filing fee required by Neb. Rev. Stat. § 33-125. The Judicial Branch filing fees and court costs schedule effective July 1, 2026 lists the counter total for an informal probate at $44, or $45 when a will is proved. Confirm the current amount and payment method with the clerk before filing.
  5. For informal probate, wait for the statutory timing rule. The registrar may issue the written statement of informal probate only if at least 120 hours have elapsed since death (Neb. Rev. Stat. § 30-2415).
  6. After appointment, the clerk publishes notice to creditors once a week for three successive weeks, with first publication within thirty days after appointment. Claims covered by the published notice are barred two months after the date of first publication, subject to the statute's limited extension procedure (Neb. Rev. Stat. § 30-2483, § 30-2485).
  7. Handle required notices, including notice to the Department of Health and Human Services if the decedent was 55 or older or resided in a medical institution, as required by Neb. Rev. Stat. § 30-2483.
  8. Obtain Letters after appointment. The court provides one certified copy of letters of appointment without charge under Neb. Rev. Stat. § 33-125(2); ask the clerk what any additional certified copies cost before ordering them.
  9. Administer the estate, inventory the assets, pay valid claims, and address Nebraska inheritance tax. The Sheridan County Court determines the inheritance tax, which is a county tax due twelve months after the date of death (Neb. Rev. Stat. § 77-2010, § 77-2018.01, § 77-2004).
  10. If a hearing is set, ask the clerk how the county judge wants remote appearance requests handled. Nebraska law permits telephone or videoconference hearings in the circumstances stated in Neb. Rev. Stat. § 25-2704, and Sheridan County follows the twelfth county judge district's technology rule.
  11. Distribute property only after the estate is ready for distribution, then close the estate using the Nebraska Probate Code closing process, including a closing statement when that route applies (Neb. Rev. Stat. § 30-24,128).

Local nuance

Sheridan County-specific considerations

Local pointWhat it means for a Sheridan County estate
Hours conflictThe Judicial Branch listing gives 8:00 am to 12:00 pm and 12:30 pm to 4:30 pm, Monday through Friday. Sheridan County's website gives 8:00 am to 4:30 pm, Monday through Thursday, and 8:00 am to 1:00 pm Friday. Call 308-327-5656 before traveling, especially Friday afternoon.
Shared clerk magistrateThe Sheridan County Court clerk magistrate also serves another county under the multi-county clerk magistrate rule in Neb. Rev. Stat. § 24-507. That does not create a second filing location for a Sheridan County estate; file in Rushville.
Real-property affidavit locationThe Affidavit for Transfer of Real Property without Probate is recorded with the register of deeds office, not with the county court (Neb. Rev. Stat. § 30-24,129). In Sheridan County, call 308-327-5650 and ask that office about recording requirements and any recording charge.

Scenarios

SituationLikely Sheridan County pathWhere Sunset helps
Surviving spouse w/ co-owned homeStart with the deed and account titles. If only personal property remains and the $100,000 ceiling under Neb. Rev. Stat. § 30-24,125 fits, CC 15:40 is presented to the holder of the property after the required waiting period. If the decedent's Nebraska real-property interest fits the separate $100,000 ceiling, CC 15:41 is recorded with the register of deeds under Neb. Rev. Stat. § 30-24,129. If Letters are needed, file with the Sheridan County Court in Rushville.Sunset identifies accounts and property, organizes the estate settlement checklist, and helps decide whether a court filing or affidavit route should be reviewed by a local attorney.
Out-of-state adult child w/ small estateIf the personal-property affidavit route applies under Neb. Rev. Stat. § 30-24,125, a trip to Rushville may not be needed. If Letters are needed, a person filing without a lawyer may mail papers to P.O. Box 430, Rushville, NE 69360, or fax them to 308-327-5623 with the cover sheet required by Neb. Ct. R. § 6-601(B). If a hearing is set, ask about telephone or videoconference appearance under Neb. Rev. Stat. § 25-2704.Sunset helps find assets, prepare the family information an attorney or court filing requires, and coordinate next steps without starting from a blank document.
Parent settling predeceased child's estate, home must be soldNeither affidavit route is a sale order. Open the estate with the Sheridan County Court. A clerk magistrate may hear noncontested estate and inheritance tax matters, but cannot determine title to real estate or authorize a sale or mortgage; those matters go to a county judge (Neb. Rev. Stat. § 24-519, § 24-507). The Sheridan County Court also determines Nebraska inheritance tax, which is due twelve months after the date of death (Neb. Rev. Stat. § 77-2010, § 77-2018.01, § 77-2004).Sunset gathers asset information, flags the home-sale issue for attorney review, and connects the family with a vetted local probate attorney when court authority is needed.

When to hire an attorney

Nebraska does not require a personal representative to hire a lawyer, and the Judicial Branch's estates materials say the law allows self-representation. The same materials say filing an estate will most often require an attorney's help, and in Sheridan County there is no published local application or petition form for opening an estate. Limited Scope Representation through nebraskajudicial.gov may be a middle option, and Legal Aid of Nebraska can be reached at 1.877.250.2016 for income-based screening, though estate administration is not among its published practice areas. For a contested estate, a home sale, unclear heirs, creditor disputes, or inheritance tax questions, Sunset connects families to a vetted local probate attorney.
