A formal probate is charged on a schedule keyed to the gross value of the Nebraska estate at death, from $22 on estates of $1,000 or less to $1,500 over $5,000,000 (Neb. Rev. Stat. § 33-125). The statewide counter total schedule effective July 1, 2026 lists $44 for an informal estate, or $45 when a will is proved and the certificate of probate of will issues. | Remote appearance | Nebraska law allows a county court to hear all nonevidentiary hearings, and any evidentiary hearing the court approves with all appearing parties' stipulation, telephonically or by videoconference in a way that preserves an accurate record (Neb. Rev. Stat. § 25-2704). Loup County sits in District 8, and Rule 8-2 requires advance court approval for a remote hearing. |

Before you begin — know the assets and liabilities
Before you choose a Nebraska filing path, list the assets, debts, account titles, beneficiary designations, land records, and expected creditor claims. In Loup County, that first inventory also tells you whether you need the county court in Taylor, the Loup County Register of Deeds for a real property affidavit under Neb. Rev. Stat. § 30-24,129, or no court filing for a qualifying personal property affidavit under Neb. Rev. Stat. § 30-24,125.
Sunset's estate settlement platform searches across more than 2,300 financial institutions to help families find accounts and assets before they prepare a filing. A cleaner asset picture reduces repeat trips, repeat fax filings, and avoidable corrections during estate settlement.
Which court handles jurisdiction
Probate for Loup County is filed with the clerk of the Loup County Court at the Loup County Courthouse in Taylor. The court uses P.O. Box 146 for mail, but the ZIP printed for that P.O. Box differs between the Judicial Branch and Loup County government, so call 308-942-6035 before mailing anything time-sensitive.
Nebraska district courts do not hear probate; a will is proved and letters are issued in the county court, which has exclusive original jurisdiction of all matters relating to decedents' estates (Neb. Rev. Stat. § 24-517). Loup County sits in Nebraska's eighth county judge district, which is how county judges and the county court's local rules are assigned; the estate case itself is filed at this county's own courthouse in Taylor (Neb. Rev. Stat. § 24-502, § 24-503).
Venue for the first informal or formal testacy or appointment proceeding is the county where the decedent had domicile at death, or, if the decedent was not domiciled in Nebraska, any county where the decedent had property (Neb. Rev. Stat. § 30-2410).
The jurisdiction process
- Choose the opening track. Informal probate uses an application to the registrar; the registrar's acts are performed by a county judge or by a person designated by the court in a written order, and the application is delivered to the clerk of the county court (Neb. Rev. Stat. § 30-2216). Formal probate uses a petition to the court and requires notice to interested persons.
- Gather the death certificate, the original will if there is one, account information, deed information, creditor information, and names and addresses for heirs and devisees. If the will accompanies an informal application, Nebraska law also includes a 120 hours rule before informal probate may issue (Neb. Rev. Stat. § 30-2415).
- File with the clerk of the Loup County Court in Taylor. You may file in person during posted hours, mail to P.O. Box 146 after confirming the ZIP with the clerk, or, if you are filing without a lawyer, fax to 308-946-7756 with the uniform cover sheet under Neb. Ct. R. § 6-601(B). A Nebraska attorney must use electronic filing under Neb. Ct. R. § 2-202.
- Pay the Nebraska county court filing fee. Informal proceedings that are commenced and closed informally start at $22, with another $22 for each later petition or application in that informal proceeding; formal probate fees are based on the gross value of the Nebraska estate at death (Neb. Rev. Stat. § 33-125).
- Address hearing scheduling. Informal probate may not require a courtroom hearing if the registrar accepts the application. Formal probate proceeds on notice and may require a hearing, although an unopposed formal testacy petition may be decided on the pleadings if the court is satisfied with the required showing.
- If a remote hearing is needed, follow District 8 Rule 8-2 and Neb. Rev. Stat. § 25-2704. For the common nonevidentiary request, the moving party files a motion and proposed order at least 5 days before the hearing, certifying mutual consent and that no evidence will be offered; a request to join a hearing that was not already set as remote is due at least 3 days before.
- After appointment, the clerk publishes notice to creditors once a week for three successive weeks, with first publication within thirty days after appointment. Creditors are generally barred two months after the first publication if notice is given as required, and the party or attorney handling the proceeding must mail the published notice and prove mailing (Neb. Rev. Stat. § 30-2483, § 30-2485).
- Give any required notice to the Department of Health and Human Services if the decedent was fifty-five or older or resided in a medical institution, because Nebraska makes that notice part of the creditor-notice statute (Neb. Rev. Stat. § 30-2483).
- Use the Letters issued by the county court to collect assets, manage claims, and transfer property. Nebraska calls the authority document letters testamentary when there is a will and letters of administration when there is no will; one certified copy of letters of appointment is provided without charge in a formal probate (Neb. Rev. Stat. § 33-125).
- Prepare the inventory, handle creditor claims, determine Nebraska inheritance tax in the Loup County Court, and pay any county tax due twelve months after the date of death (Neb. Rev. Stat. § 77-2010, § 77-2018.01, § 77-2004).
- Distribute the remaining property and close the estate. Nebraska uses a closing statement in the appropriate probate closing path (Neb. Rev. Stat. § 30-24,128).
Forms and documents
Probate forms in Loup County
Local forms. Loup County publishes no county-specific probate packet, cover sheet, or local court-cost sheet for estates. The court's local page points families back to the Nebraska Judicial Branch materials.
Statewide estate forms. Nebraska publishes CC 15:40, Affidavit for Transfer of Personal Property without Probate, revised July 2022, for the personal property affidavit under Neb. Rev. Stat. § 30-24,125. Nebraska also publishes CC 15:41, Affidavit for Transfer of Real Property without Probate, revised October 2025, for the real property affidavit recorded with the register of deeds under Neb. Rev. Stat. § 30-24,129. Because both form titles use the words without probate, review both statutes before assuming either route fits.
Opening papers. The Nebraska Judicial Branch does not publish a fill-in form for the application or petition that opens an estate. Its estates materials state that estates differ and that the Self-Help Center cannot provide forms for every situation. The clerk of the Loup County Court may receive filings, but does not draft the application or petition for you.
Fax cover sheet. If you are filing without a lawyer and fax a court document, use the uniform fax cover sheet as the first page. Nebraska fax filing for non-attorneys is governed by Neb. Ct. R. § 6-601(B) and currently runs until July 1, 2028.
Flowchart. The Judicial Branch provides a flowchart for informal probate filed with a will at nebraskajudicial.gov. It applies to a testate, uncontested informal case and does not cover a no-will estate, a contested will, or contested asset distribution.
Local nuance
Loup County-specific considerations
| Local point | What it means for filing |
|---|---|
| Shared clerk magistrate | The clerk of the Loup County Court is a clerk magistrate under Neb. Rev. Stat. § 24-507 and also serves another county court. Use Loup County's own address, phone, fax, and hours for a Loup County estate. |
| Street address | Use 408 4th Street, Taylor, NE 68879 for the Loup County Courthouse. |
| Mailing ZIP | The court uses P.O. Box 146, Taylor, NE, but the ZIP differs between the Judicial Branch listing and Loup County government. Call 308-942-6035 before mailing filings. |
| Hours | The court listing closes Monday through Thursday at 4:30 pm, while Loup County government lists 5:00 pm. Both list a midday closure and Friday morning hours only. Call before travelling. |
| Register of deeds | The Loup County Register of Deeds is in the same courthouse at 408 4th Street, Taylor, with mailing P.O. Box 187, Taylor, NE 68879. That office, not the county court, records a real property affidavit under Neb. Rev. Stat. § 30-24,129. |
Recent updates
| Update | What changed |
|---|---|
| District 8 remote hearing rule | District 8 Rule 8-2 was amended April 16, 2025. It requires court approval for remote hearings and sets advance motion timing for nonevidentiary and evidentiary remote hearing requests under Neb. Rev. Stat. § 25-2704. |

Scenarios
| Situation | Likely Loup County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with a co-owned home | Start with the deed and account titles. If only personal property remains and the $100,000 affidavit route fits after 30 days, use CC 15:40 with the holder of the property rather than the court (Neb. Rev. Stat. § 30-24,125). If a Nebraska real property interest must transfer and the separate $100,000 assessment-roll ceiling fits, CC 15:41 is recorded with the Loup County Register of Deeds under Neb. Rev. Stat. § 30-24,129. If those routes do not fit, file with the clerk of the Loup County Court in Taylor. | Sunset helps identify accounts, deeds, debts, and beneficiary designations before you decide whether a court filing is needed. |
| Out-of-state adult child with a small estate under Neb. Rev. Stat. § 30-24,125 | If the personal property affidavit applies, a trip to Taylor may not be needed because CC 15:40 is presented to the property holder under Neb. Rev. Stat. § 30-24,125. If Letters are needed, mail the filing to P.O. Box 146 after confirming the ZIP, or fax to 308-946-7756 with the uniform cover sheet under Neb. Ct. R. § 6-601(B). If a hearing is set, District 8 Rule 8-2 requires a motion at least 5 days before a nonevidentiary remote hearing request (Neb. Rev. Stat. § 25-2704). | Sunset organizes the asset list, generates a tailored filing packet, and helps coordinate a Nebraska attorney when the no-probate affidavit route does not fit. |
| Parent settling a predeceased child's estate, home must be sold | A sale generally means the affidavit paths are not enough. A clerk magistrate may hear noncontested estate matters, but not title to real estate or authorization to sell or mortgage real estate; that issue goes to a county judge (Neb. Rev. Stat. § 24-519). The clerk publishes notice to creditors, claims are barred two months after first publication when notice is proper, and the Loup County Court determines Nebraska inheritance tax (Neb. Rev. Stat. § 30-2483, § 30-2485, § 77-2004). | Sunset helps find the assets, prepare the probate packet, track creditor and tax deadlines, and connect the family with a vetted local probate attorney. |

When to hire an attorney
Nebraska does not require a personal representative to hire a lawyer, and the Judicial Branch's estates materials say the law allows self-representation. The same materials say filing an estate will most often require an attorney's help, and that the Self-Help Center cannot supply forms for every situation. In Loup County, there is no local form for the opening application or petition, so Limited Scope Representation through nebraskajudicial.gov may be a middle option when you need help with part of the case. Sunset connects families to a vetted local probate attorney.
How Sunset helps
Find the accounts and assets
Sunset searches more than 2,300 financial institutions to help identify accounts, balances, and assets that may belong in the estate. That gives the family a clearer starting point before deciding whether to use an affidavit, open a county court case, or record a real property affidavit.
Generate the probate packet
Sunset turns the family's information into an organized estate settlement packet for the Nebraska path that fits the situation. For Loup County, that means keeping the county court filing, the fax cover sheet, the register of deeds step, and Nebraska inheritance tax deadlines in the right places.
Find a local probate attorney
When the estate needs a lawyer, Sunset helps connect the family with a vetted probate attorney who understands Nebraska county court practice. That is especially useful when there is real estate to sell, a formal petition, contested notice issues, or inheritance tax work.
Sunset is free for families
Sunset is free for families to use. The goal is to make estate settlement easier to start, easier to organize, and easier to hand off to counsel when the Nebraska filing becomes too complex to handle alone.
Frequently asked questions
Where do I file probate in Loup County?
File with the clerk of the Loup County Court in Taylor. The courthouse is at 408 4th Street, Taylor, NE 68879, and the court uses P.O. Box 146 for mail. Call 308-942-6035 before mailing because the ZIP printed for that P.O. Box differs between public court and county listings. Nebraska district courts do not hear probate; the county court has exclusive original jurisdiction over decedents' estates (Neb. Rev. Stat. § 24-517).
Do I need a lawyer for probate in Loup County?
Nebraska law allows self-representation, and the Judicial Branch says so in its estates materials. The same materials also say filing an estate will most often require an attorney's help. If the case involves real estate, contested issues, tax questions, or no available form for the opening application or petition, consider limited-scope or full representation.
How much does it cost to open probate in Loup County?
The statutory base is $22 for a probate proceeding commenced and closed informally, with another $22 for each later petition or application in an informal proceeding. Formal probate is charged on a schedule based on the gross value of the Nebraska estate at death, from $22 for estates of $1,000 or less to $1,500 over $5,000,000 (Neb. Rev. Stat. § 33-125). The statewide counter total schedule effective July 1, 2026 lists $44 for an informal estate, or $45 when a will is proved and the certificate of probate of will issues. Confirm the current total with the clerk before filing.
Can I avoid probate in Loup County with an affidavit?
Possibly. For personal property, CC 15:40 may be used after 30 days if the personal property limit and other conditions in Neb. Rev. Stat. § 30-24,125 are met; it is presented to the holder of the property, not filed with the court. For Nebraska real property, CC 15:41 may be recorded with the Loup County Register of Deeds if the separate real property requirements in Neb. Rev. Stat. § 30-24,129 are met. Both routes use $100,000 ceilings, and the personal property ceiling was raised by 2022 Neb. Laws LB 1124, signed April 18, 2022; the real property ceiling was raised by 2024 Neb. Laws LB 1195, signed April 15, 2024.
Can I file by fax or email in Loup County?
A person filing without a lawyer may file in person, by mail, or by fax to 308-946-7756 with the uniform cover sheet under Neb. Ct. R. § 6-601(B), until July 1, 2028. A Nebraska attorney must use electronic filing under Neb. Ct. R. § 2-202. The court's email address is for questions, not filings, because Nebraska court rules do not allow email filings in court cases (Neb. Ct. R. § 2-212).
Can I appear by phone or video for a Loup County probate hearing?
Nebraska law allows nonevidentiary hearings, and evidentiary hearings approved by the court with the stipulation of all appearing parties, to be heard telephonically or by videoconference (Neb. Rev. Stat. § 25-2704). District 8 Rule 8-2 applies in Loup County. For a nonevidentiary remote hearing request, file the motion and proposed order at least 5 days before the hearing; to ask to join a hearing that was not already set as remote, file at least 3 days before.
How do I look up a Loup County estate case?
Use the statewide Nebraska.gov JUSTICE trial court case search at https://www.nebraska.gov/justice/case.cgi. A general list search has no charge, viewing case details is $2 per case, and frequent users can open a Nebraska.gov subscriber account for an annual $100. The same case information is available without charge at courthouse kiosks and law libraries.
Is there a Nebraska inheritance tax in Loup County?
Yes. Nebraska inheritance tax is a county tax: the Loup County Court determines it and it is paid to the county, with the tax due twelve months after the date of death (Neb. Rev. Stat. § 77-2010, § 77-2018.01). Rates and exemptions depend on the beneficiary's relationship to the decedent and whether the death was before or on or after January 1, 2023 (Neb. Rev. Stat. § 77-2004).
What are the Loup County Court hours?
The Judicial Branch lists Monday through Thursday, 8:30 am to 12:00 pm and 1:00 pm to 4:30 pm, and Friday, 8:30 am to 12:00 pm. Loup County government lists Monday through Thursday closing at 5:00 pm and Friday morning hours only. Call 308-942-6035 before travelling, especially late in the afternoon.
